Dak Prescott accuser drops $100 million sexual assault lawsuit to refile in neighboring county

The woman accusing Dak Prescott of sexual assault from an encounter in 2017 has dropped the $100 million lawsuit, but according to her lawyer, Yoel Zehaie, they will be re-filing the lawsuit in Collin County. The initial lawsuit, filed in Dallas County, accuses Prescott of sexually assaulting the woman in a vehicle in the parking lot of a Dallas-area strip club. The Dallas Cowboys quarterback filed his own lawsuit against his accuser in Collin County last month, claiming that she is extorting him.

“We wanted to have it all in Collin for purposes of convenience,” Yoel Zehaie told LoneStarLive.com. “We are still 1000% pursuing this case.”

Though the statute of limitations on a civil sexual assault claim has expired, the accuser’s attorney explained last month that there are grounds for the lawsuit based on “other causes.”

“There are other causes of action that I don’t want to go too deep in detail about it, but that we do plan on filing soon,” Zehaie told ProFootballTalk. “It’s imminent and you will see it soon. So, to answer your question, are there things that we can sue him for? Yes.”

Prescott facing civil suit amid contract negotiations

Dallas Cowboys owner Jerry Jones opened up last month about the allegations and Prescott’s status with the team as he enters the final year of his contract.

“We are very knowledgeable of it,” Jones said, via Michael Gehlken of the Dallas Morning News. “Of anybody, I can say you work through the legal aspects of it. So, very aware of it. Not uncomfortable with it in any way. Hate it that the issue has to have any negative aspect to it all for everybody concerned. I can say that we’re just very aware of the details and very comfortable.”

As of mid-March, Prosper Police and Dallas Police are investigating both the claim of sexual assault and the claim of extortion involving the Cowboys star quarterback. Prescott’s attorney told the DMN that the encounter between the QB and the alleged assault victim was consensual. The NFL hasn’t issued any statement yet regarding the allegations against him.

“Mr. Prescott — a new father to a baby girl — has great empathy for survivors of sexual assault. He fervently believes that all perpetrators of such crimes should be punished to the fullest extent of the law,” wrote Levi McCathern, Precott’s lawyer, in a statement in March. “To be clear, Mr. Prescott has never engaged in any nonconsensual, sexual conduct with anyone. Lies hurt. Especially, malicious lies. We will not allow the Defendant and her legal team to profit from this attempt to extort millions from Mr. Prescott.”
