1. How do you attorney guys on the board think this F. Moore case is going to end up?

In my non legal mind, I say it doesnt work out the way FM wants it too.....

2. Is CJ Johnson going to qualify?

during his recruitment i thought he was a standup guy, but ever since the flip flop, it seems to me he has gone full tilt Dontae Walker and thug life.....I can honestly say I am glad he is not on our team, especially after reading some of his recent tweets....seems he let this go to his head....and to be honest, I have a feeling its gonna get to Q. Evans head too....and if it does, let him go somewhere else....

and with his mind on his bitches and his money, I just have the gut feeling he isnt going to qualify.....which may be the best thing for the kid if his head isnt on straight....

Not an attorney, but I see a settlement taking place. Going to be hard to prove that Cohen injured Moore.
Now, the next issue...How will the NCAA view this?

But, the players that are coming out- no pun intended- have one big problem with their accusations. Like I said, the coaches document all of the times that they practice. The players also sign off on it.

I know in the medical field, if I signed off on something- whether it was done ethically or not to my knowledge- that's pretty much me saying that I agreed with whatever I was signing off on. I can't see how signing off on practice times would be any different.

Secondly, it doesn't help these players that Jarrod Parks is calling them liars, and I'm pretty sure all of the coaches will also dispute the charges.

I also think that Linton might end up being collateral damage here. He's actually the one that is looking like he doesn't know what he is doing.

So, basically, this is a pretty obvious smear campaign. I don't know if they will settle out of court or if it will go to trial- there's my limited legal knowledge. But, I don't think that Moore will win if it goes to trial.

is the possibility that multiple players report signing blank forms. So far we have 3, all with issues to be sure. If, under questioning by the university or other parties, pro-Cohen players say basically the same thing then that's a problem. Submitting fraudulent paperwork to the compliance office is probably frowned upon. I'm not the least bit concerned about a trial. My concern is how the powers that be would view the paperwork.

For the record, I support Cohen

I mean, it's practice and why wouldn't a kid playing baseball in college not want to practice and get better even if Cohen did practice 40 ours per week. I suppose Polk let the pussies do what they wanted and now it it showing with lawsuits and crying, Tom Hanks was right, "there's no crying in baseball"!

I have not read the pleadings but based on the articles I've read summarizing the allegations, I believe Cohen and MSU are entitled to immunity under the Tort Claims Act.

The burden is on Moore to prove the practice amount he received under Cohen damaged his earning potential.

Even IF rules by a governing body such as the NCAA were broken, that doesn't mean his pro potential was damaged. Hell, I'd argue the rules stipulating practice hours are in place much more so to allow time for academics rather than protect players from injury. And on second thought... why don't they just call in a couple of professional pitchers and ask them about how many hours they practice and stay injury free.

That being said.. I really hope our staff has its ducks in a row on this. Things like this can take on a life of their own within an athletic department.

But if this gets thrown out and Moore loses, which is what I think will more than likely happen, then I'm not so worried.

Actually this same accusation came up against Polk and nothing came of it.

He's just trying to keep it in court long enough to get a settlement. Ignoring the potential immunity issues, theloss of pro earnings is not really a viable claim because the damages are so speculative. However,they probably think that if they can survive summary judgment, the prospect ofbeing drug through the mudfor a few months (especially if there are potential NCAA violations related to practice time), will make State want to settle.

I think it would probably be in MSU's best interests to let it go to court. And I guess that is what MSU will do.

Plus, unless I'm mistaken- again not a lawyer- the Moore's could only get so much out of MSU, and what they could get out of MSU is probably a drop in the bucket to MSU.
