Heavens eligible?

A poster on Gene's free board--yeah, I know--mentioned a few days back that Heavens would be ineligible. Anything to that?

addressed that issue and he said that he should be fine. I dont know what happened, but apparently there was a little smoke to the fire. I think the response was "He'll be fine by the fall"
