and that.....in my opinion....is a positive ruling by the Cleveland County district judge. It's good for all concerned and especially for Mixon, who by all indications, has decided to learn from his mistake. He's applied himself academically, stayed in shape, done community service and undergone cognitive behavior counseling....and remained at OU.
Public viewing of this video would have represented a form of punishment that I believe would have been excessive and might have ruined Mixon's life far beyond just his football career. It's a reprieve that was fair when considering the bigger picture for both participants....in my opinion.
The more I read of him, the more I believe he made a bad knee jerk response in a situation he never should have been in.
What I hope, more than anything else, is that all the players learned something from this terrible event....that they represent the team, the university, their families and themselves as high profile athletes at a big time football program both on and off the field. I also hope that the coaches use this event as a warning and/or reminder to incoming players about responsibility and accountability and that the celebrity status they have had in high school is no excuse for bad behavior in the adult world....and that there is now a zero tolerance policy for violating rules of conduct.
Coach Gundy believes Mixon has learned his lesson and is a better person now. That is good enough for me.
As for Amelia Molitor, I hope she learned the same lesson and has fully recovered from her injuries. Perhaps she has also received some behavioral counseling.....it seems to me that she needs it at least as much as Mixon.

That is no surprise.

Actually, Gramps, this opinion of mine towards Mixon is a complete reversal of how I felt when this event first happened. I can tell you that it has nothing to do with Mixon returning to play football at OU, but why bother ? You are convinced that I want Mixon playing regardless of his misdeed.....and there's nothing I care to say to convince you otherwise.

He was guilty. That is all I was trying to say. Why not show all that went on?

Yes, he was guilty and he has paid for his mistake.....and will continue to pay for it every time he takes the field by opposing teams' fans, like you.
I believe showing the video would be a form of piling on and cause Mixon far more and far lasting condemnation than he deserves.
I may be eventually proven wrong about Mixon if he were to repeat getting into trouble. I've been wrong before....marrying my first wife, voting for "W' twice and thinking that message boards were only about casual, civil football talk. If I'm wrong, so be it.

I believe I agree with you on some level but maybe for a different reason. We the public do not have a given right to see and/or hear everything in my opinion. I am not a big fan of hearing 911 calls or viewing taped evidence; I understand this is my personal take. Our society can be ****** enough without the violent "evidence" obtained through an open record request. I either have faith in the justice personnel or as is the case most of the time do not feel like tuning into the jerry springer show.

I agree with you on this one CT, first of all if had been anyone else other than an athlete this would be a none issue. It's no one's business what's on that tape. The media knows what's on it and have reported it. Let's also remember Joe was 17 turning 18 when the mistake happens. He did his time, so it's now time to move on and support this kid.

Freedom of Information Act and Oklahoma state law. Judge has ruled against what the law says, and the appeals process will probably get the tape released eventually. Do I want to see it? No. But if someone does, that is their right under the law. I agree with what the Oklahoman says, better now than when he is looking good in the middle of the season and TMZ releases it.

100% this. With most everything in this world, it eventually gets released, or leaked out. I would rather have OU deal with the fallout now, than it coming out during the middle of a season with the possibility of distracting the entire team with the drama it would unleash. Get it over with now, and by the time the season starts it will mostly be an after thought.

Freedom of information act, stopped a long time ago, when they stopped giving new address information at the post office. The public is owed nothing. And the judge has ruled on this. Public has no rights to video, and the media has alread see it. So none issue.

Well, I provided a link to an article that says it is against Oklahoma State law. So if you have a link that says otherwise...

As for what the Oklahoma law states.... you can read that here: http://www.odl.state.ok.us/lawinfo/docs/2006-LibraryLaws-PartE.pdf

51 O.S. 24A.2. Political Power - Public Policy and Purpose of Act.
As the Oklahoma Constitution recognizes and guarantees, all political power is inherent in the people. Thus, it is the public policy of the State of Oklahoma that the people are vested with the inherent right to know and be fully informed about their government. The Oklahoma Open Records Act shall not create, directly or indirectly, any rights of privacy or any remedies for violation of any rights of privacy; nor shall the Oklahoma Open Records Act, except as specifically set forth in the Oklahoma Open Records Act, establish any procedures for protecting any person from release of information contained in public records. The purpose of this act is to ensure and facilitate the public's right of access to and review of government records so they may efficiently and intelligently exercise their inherent political power. The privacy interests of individuals are adequately protected in the specific exceptions to the Oklahoma Open Records Act or in the statutes which authorize, create or require the records. Except where specific state or federal statutes create a confidential privilege, persons who submit information to public bodies have no right to keep this information from public access nor reasonable expectation that this information will be kept from public access; provided, the person, agency or political subdivision shall at all times bear the burden of establishing such records are protected by such a confidential privilege. Except as may be required by other statutes, public bodies do not need to follow any procedures for providing access to public records except those specifically required by the Oklahoma Open Records Act.
Added by Laws 1985, c. 355, § 2, eff. Nov. 1, 1985. Amended by Laws 1988, c. 187, § 2, emerg. eff. June 6, 1988.

If you have something that can refute this, please provide it.

The Appellate Courts will overrule the judge's decision, so better SOONER than later. Get it over with already.
Freedom of Information Act is still used on a daily basis and was cited in several of my posts on other threads, so I don't feel as if I need to go over all of that again. The public was owed nothing when Hitler took over in Germany as well, and we saw how that turned out...

You're speculating, no one knows if it will be over ruled or not. I know it's a law I've tried to use it. However another law prevented it. The public has no right to the video, the public will not see the video. Don't matter what links I provide or don't provide.

According to some, the law was re-written and went into effect on Nov 1, 2014 that would have required the tape to be copied and supplied. But the NPD returned the video copy to Pinkleman's ( the owner of the tape) on Oct 20th, 2014. So the judge dropped the lawsuit.

So says some. I suspect that the owner, if they elected to and/or wanted to, could 'sell'l the video for profit. There's still a chance that the public will see the video. But in reality, we have no claim to the video and/or the viewing of the video until it's released to the owners of the video.

If you're talking about Pinkleman's, they destroyed their copy the day it was returned to them.

Open records act does not apply to private property, which is what the video is. Just because it may hold value as evidence doesn't strip it of its status of being private property. You have as much right to that video as you have to surveillance video from Walmart taken yesterday at 1 pm.
