23XI, FRM vs. NASCAR trial: Emotional Heather Gibbs of JGR delivers explosive testimony
On the stand today, Heather Gibbs delivered emotional testimony that could be the most impactful of the trial up to this point. Gibbs went just ahead of Michael Jordan today in the witness lineup. Her testimony didn’t paint a great picture of NASCAR and Jim France.
Heather Gibbs answered questions for under an hour today at the federal courthouse in Charlotte, North Carolina. During her testimony, Gibbs was asked about the charter deadline. She also reflected on how she ended up in a leadership position at Joe Gibbs Racing.
“Everything’s going so fast,” Gibbs said, via Bob Pockrass of FOX Sports. “That’s the legacy of Coy. That’s the legacy of J.D. … If we don’t take the payout they are offering, we can’t keep going. … It’s like you have a gun to your head. If you don’t sign it … everything is gone.”
While on the stand, Heather spoke about Joe Gibbs calling Jim France. It was around the time the charter deadline was given to the teams. “Don’t do this to us,” Coach Gibbs told France, via Jeff Gluck of The Athletic.
Jim France responded, “If I wake up and I have 20 charters, I have 20. If I have 30, I have 30.”
Heather Gibbs’ testimony was going to be emotionally charged. We knew that before the trial. There is a letter that she wrote to NASCAR and Jim France, asking for permanent charters. It was alleged that France was “cursing” with every line he read. However, Steve O’Donnell denied that in his testimony this week.

Heather Gibbs testimony could be impactful on jury
On top of the business side of things, Heather Gibbs also recounted for the first time publicly the death of her husband, Coy Gibbs. In 2022, Ty Gibbs, son of Heather and Coy, won the NASCAR Xfinity Series championship. Coy was dead by the next morning. A tragic moment for the family who had lost J.D. Gibbs a few years prior.
As Pockrass reports, Heather testified in court, “We got to celebrate the most special night and he didn’t wake up the next day. … It was obviously awful.”
This highly emotional testimony is going to have an impact. Juries are human, and emotions are part of what makes us human. On top of that, it doesn’t paint NASCAR or Jim France in a positive light. Not only is Joe Gibbs Racing one of the most storied organizations in the sport, with a three-time Super Bowl champion coach as the owner, but it is a family business, just like NASCAR. They have a legacy to maintain and fight for as well, especially after the tragic losses of both J.D. and Coy.
We will see how this ends up factoring into the final verdict. The NASCAR trial continues after a lunch recess today. Michael Jordan will take the stand.
