Erica Herman, the ex-girlfriend of PGA Tour star Tiger Woods, has dropped her appeal and sexual assault allegations against him, according to Natasha Dye of PEOPLE.

Per court documents from Florida’s Fourth District Court of Appeal, Herman filed an official notice to dismiss her appeal. The 38-year-old initially filed it to nullify a Non-Disclosure Agreement (NDA) she signed in 2017 when their relationship began. A judge ruled in May that Herman could not be released from her NDA, leading her to file the appeal, Dye writes.

Herman cited the Speak Out Act in her original lawsuit, which allows an exception to NDAs for victims of sexual assault. She stated, however, in her new filing Friday that she “was never a victim of sexual harassment or sexual abuse at the hands of Tiger Woods or any of his agents and it is her position that she never asserted a claim for such.”

Herman filed her first lawsuit against Woods in December of 2022. She claimed she was owed $30 million due to Woods breaking the terms of their “oral agreement.” Herman alleged that the 15-time major champion kicked her out of his house, even though the terms of their agreement allowed her to stay there for another five years.

Woods’ attorneys have disputed Herman’s claims.

“Ms. Herman’s position is utterly meritless,” Woods’ attorneys said in a filing. “It is a transparent abuse of the judicial process that undermines the purpose of the federal statute and those whom the statute seeks to protect.”

Tiger Woods recovering from right ankle surgery

Woods, 47, played in just two events during the 2022-23 season. He made the cut at the 2023 Masters Tournament in April, but had to withdraw due to a foot injury. Woods made it through all four rounds of The Genesis Invitational in February, finishing T45.

Woods, who underwent right ankle surgery two weeks after the Masters, recently said he was pain free in his ankle.

“My ankle is fine. Where they fused my ankle, I have absolutely zero issue whatsoever,” Woods said. “That pain is completely gone. It’s the other areas that have been compensated for.”

Woods added he isn’t completely pain free in other areas.

“All the surrounding areas is where I had all my problems, and I still do,” Woods said. “So you fix one, others have to become more hypermobile to get around it… It can lead to some issues.”
