You throw him in jail (or line him up against a wall) not to punish him, but to serve as a warning to others not to do the same.

I can see that.

What it seems like the guy is guilty of is not sedition but rather being an absolute, colossal dumbass who could not foresee obvious consequences.

Him not getting any time is ridiculous. But I don't think he should be hung or put away for a long time either.

That's just a really tough case to have to deal with for the military justice system.

There is also the issue of his own safety in a military prison. He probably would be killed.

This was the wrong decision. He absolutely needed to serve some time in prison. It doesn't matter if he spent five years in captivity. That's his fault for betraying the men he took an oath to protect.

No one died searching for him, but two soldiers suffered life-altering injuries. Navy SEAL Jimmy Hatch lost his leg in a mission to find Bergdahl. Army Sergeant First Class Mark Allen was shot in the head during a different search. As a result, Allen is permanently paralyzed and mute.

Those injuries are more than enough to justify punishment, and that's not even considering the need to deter other soldiers from doing something similar in the future.

Maybe the court's decision had something to do with wanting to avoid the unlawful command influence question given Trump's tweets. It doesn't matter. You still give the guy a couple of years. His appeal likely would have taken that long anyway.

In the podcast he came off as an absolute weirdo.

Was he autistic? Just seemed to not have any affect at all and not really understand how his actions could've affected other people.

I don't know if you can look at it like that. It isn't a tort where foreseeability and causation is an essential element. (And I understand that mens rea + behavior + consequences = criminal liability).

He should have known that the U.S. military would pull out all stops to find him but I find it a reach to put the injuries from the rescue operations directly on his head. He has some responsibility but it is diffuse.

He's just an absolutely selfish, deluded jackass.

Just a really, really hard case.

-no deaths can be *directly* attributed to a search for bergdahl. 6 dudes from his unit were killed...but not during an active search. Two men were seriously maimed in an active search. That is enough for me to justify him rotting in prison...no need for hyperbole or aggrandizement.

Wrong. Fake news. A service dog died, and 2 soldiers were injured searching for him. One was shot in the head and is basically an invalid.

Bergdahl had no business being in the military, let alone in Afghanistan. Dude was OCD and a borderline schitzophrenic. Should he be punished for walking off the base and trying to roll the bus on his commanders? Yes.

But if you're mad over this, blame Trump. His comments compromised the case and influenced the judge's decision.

But the guy essentially has a life sentence of shame. He's disgraced for the rest of his life, he loses all disability entitlement as a veteran, he's got a president who thinks he should be in front of a firing squad, and he has to live with soldiers who lost limb and quality of life looking for his dumb ***.

Dude had to piss on his hands to wash them from the **** he had on his hands to try to eat the scraps they threw at him for five years. So, he gets to live with those nightmares, too.

But I still think he should've gotten some time. Maybe not 14 years, but maybe 2-3.

Copout. His comments were stupid but that did not justify the decision or truly compromise the case. The comments by the judge earlier in the week showed he had a personal axe to grind with Trump.

Like Manning, he will be fully accepted/embrace in some parts of our culture and will feel no shame

False. But, the judge in this case might have been more influenced by the PC community than anything else. Believe me, Obama's 8 year reign hurt the military badly and opened the flood gates for the PC group to take hold. The military of today is no where near the the military of years past.

My point wasn't as clear as I intended.

The President doesn't appoint the military judges who preside over proceedings like Bergdahl's case. It's a different system than the civilian courts, and the selection process is more insulated from the everyday political squabbling that typically drives appointments. That's why the complaint about needing to get rid of all these liberal judges falls flat. Regardless of if you consider it a problem, replacing them isn't even an option.

IF you think there are no liberal officers then maybe your reasoning falls flat? I understand the military system is different.I also understand that they can't be replaced.
I think there were 90+ federal appointed judgeship openings when Trump took office. These along with the supreme court are actually the ones I was referring to.
