I don't think the 9th Circuit deserves that moniker any more. Just an out of date nickname to go with people's pre-conceived opinions based on their politics. That said, why did the Trump administration not take the last case to the SC? Why did they pay Washington state's legal fees for the last case? Was that cause of the dumb liberals as well?

PS - I think this one will stand.

Doesn't really matter. This is a temporary action that really won't do much anyway. This is more about looking presidential than being presidential.

I've seen a couple of people (including the Washington state AG) say that this EO is fatally flawed as well so I guess we'll see.

I am by no means a legal scholar, far from it, so maybe? It is also possible the Washington AG has bigger political aspirations and suing Trump might just be good for his future.

Suing (particularly the White House admin) and winning would never hurt any lawyer's career. He proved that the first EO was a legal failure which lended credibility to his recent comments in my eyes though unless Washington state beats Hawaii to the punch here, he'll be watching from the sidelines on this one.
