My opinion of what will happen to Trump's temporary travel ban from terrorists states

The 9th Circuit is the most liberal in the land, not even close. It has been overturned more by SCOTUS than any other Circuit Court. The libs out there will uphold the judges order overturning the ban.

Trump will wait to appeal. He needs Gorsuch on SCOTUS. He may tinker around with the EO and then resubmit to give Gorsuch time to be confirmed. When the 9th Circuit overturns the ban again, they will appeal and win at SCOTUS. The Courts cannot insert their judgments about national security over the Executive Branch, SCOTUS has already ruled on this.

The temporary ban will happen, but it will take time. Libs better pray that someone from those countries with a visa approved during this time, does not slaughter anyone.

All Gorsuch does is replace Scalia. Roberts found a way to make what seemingly was an easy decision on parts of the ACA into a contorted ruling to make it a tax. Kennedy might go to the other side. In no way is it an easy win.

I understand but there is SCOTUS precedent that I don't think even he counters.

The law is the law what does liberal have to do with it.The Job of the Court is to make sure that the President does not act illegally or abuse his power that he does not have. Obama was stopped on some of his immigration policy. Trump is not a dictator even though he wants to be one.

Doctors, how could they be against this? They want ACA repealed so I'm sure they voted for Trump.

ACP and 11 healthcare organizations offer joint recommendations on executive order on immigration

“The American College of Physicians (ACP) today joined with 11 other health care organizations, representing 275,000 physicians, to send a letter to Department of Homeland Security (DHS) Secretary John F. Kelly reaffirming their joint opposition to the executive order (EO) signed by President Trump on January 27. The letter offers specific joint recommendations on what the DHS should do to ensure medical students and physicians from the designated countries can enter and re-enter the U.S. to ensure the National Resident Matching Program and patient access to care are not adversely affected, and to prioritize admission of refugees with medical conditions. We’re especially concerned that a restrictive entry of physicians and medical students from seven Muslim majority countries will undermine medical education and result in patients losing access to their doctors, noted ACP President Nitin S. Damle, MD, MS, MACP. ‘We’re pleased that the courts have currently halted implementation of the EO, but the underlying issues of concern about the harm caused by the EO remain…’ To read the rest of the statement, visit https://www.acponline.org/acp-newsr...mmendations-on-executive-order-on-immigration.

As we have seen continually from the 9th circuit, they are extremely liberal and have "interpreted law" in that way. They are the most OVERTURNED court in the land. Did you know Massachusetts ruled in favor of Trump's temporary ban?

if that were true, then why is there such a fight by both sides on who is named to the supreme Court? That's a pretty uninformed post.

What will be the need for a temporary ban if this drags out to the SC? I would think/hope the new vetting measures would be in place by then, no? I understand the reasoning behind taking it to the SC for Trump, but I certainly hope we don't issue a temp ban months down the road out of spite.

Frankly, I think the 9th Circuit is out of control. I would like to see them slapped down again by SCOTUS. Perhaps this additional precedent will dissuade them from making these kinds of decisions again. This stuff happens to create such precedent. It is no coincidence that the 9th circuit is struck down more than any other circuit.

6 of the 7 countries have no functioning government. Perhaps we needed the 90 day period to test to see what information we can collect and what information we can't. How reliable that information turns out to be. I'm not certain.

Personally, I think the GOP should break up the 9th Circuit. It is by far the largest in the country. It covers 20% of the U.S. population and I think 40% of it's land mass. The Mountain states need a better circuit. Cases take far too long to adjudicate. I think the GOP could get this done with a simple majority vote through reconciliation.

There is legislation for this right now. Citing the same reasons.

Right, almost none of that had anything to do with what this thread was about.

It has everything to do with this thread. The 9th Circuit is easily our most liberal. It is overturned all the time by SCOTUS. More than any other circuit court. They continually refuse to acknowledge the law or precedent and impose their own judgement.

This case is pretty clear. Trump has the authority. Even lib Constitutional scholars who are opposed to the ban admit he has the authority (Turley, Dershowitz).

My most recent post is a way to begin to reverse the biases of the 9th circuit. They are too big, too powerful and take far too long on their case load. Break them up. It is good for the people of the Mountain States. California can keep the 9th Circuit and libs still can judge shop to get the rulings they want.

We all know what will happen.....The 9th Circuit will NOT change their decision.
