Circumstances change. The exemption has been in place for almost 30 years, and the ATF was bound by law to review the exemption. As of this date, they've decided to side with the overwhelming majority of public comment and leave the exemption in place, which makes perfect sense considering that they have no evidence that the rounds are being manufactured and sold for any but sporting purposes.
