Both sovereigns can prosecute. The feds have a process by which they permit a prosecutor to pursue the death penalty. It is not just simply a matter of statutory authority or the local United States Attorney’s prerogative. There is evidently a process in DC that needs to be navigated by the prosecutor to get that approval. Right now, only the possibility of the death penalty may exist through federal prosecution
Of course, that was explained in the previous posts. It's my guess is the Feds will not go through the expense of a trial if he pleads guilty and takes life without parole in the state action. But who knows what the new administration will want to do.

Not really. The previous posts acted as if the death penalty was available to the feds. It is not, unless DOJ permits it. I believe a panel reviews numerous factors. It is not common.

Biden just commuted the sentence of 37 out of the 40 people on federal death row. Maybe Luigi ought to be praying he gets charged federally and can take a plea and sentence in a bit less than a month.

The two biggest things that Trump advocates for that will help the poor are bringing back US manufacturing and stopping immigration. Despite scum bag executives and brain dead economic professors saying otherwise, if this gets done the poor will be better off. Assuming the poor don't know this is good for them is arrogance.
