Whats the ruling here. Incoming freshman practices 3 days at public school A, decides to live with other parent in district of public school B. Is he eligible to play or not? I don't see why not but not sure when being in season for a team actually starts and the 365 day rule comes into play.

He can't play. But it is Freshmen football and people tend to ignore this because no one cares if a frosh team has to go back and forfeit.

if you are looking for a serious answer, here it is -- it depends.

If the student/athlete has registered for school, then we would have to sit out. However, if he hasn't, which many freshman don't do until registration which often takes place a week before, then it is if he didnt attend the school.

This is actually an issue with some golf programs, where some kids don't make the team during early August tryout, then transfer without penalty.
