As Alan Dershowitz said last evening, this is a bad ruling. He suggested one of two courses of action. Trump either redraft the order to exclude existing visa holders and green card holders which would not give the ninth Circuit Court a leg to stand on. Or he could simply wait until Gorsuch is seated and then take this to the Supreme Court where he will win. Other congressional scholars stated that he could probably win even in a divided 4/4 court but more likely worth the wait.

Dershowitz believes he should go with the first option.

Option #1 is truly the easiest, and best option, due to Gorsuch likely not being seated until April at the earliest. However, Trump likely won't go with either option. As you know, he likes to win, so I'm guessing he'll simply continue to battle the current fight.

The ban was intended for 90 days. I assume that will be long gone by the time this goes through the SC. Issue a new EO.

I believe he could do both...but the first option is the best IMO.

I agree, I don't think his ego lets him do the smart thing. I'm not sure how he got this rich if he lets his emotions get him carried away. Business and emotions are generally not a good mix.

Go with the first option. Before releasing a new EO have a reasonable level of review by people who understand the impact and how it will be executed so that the unintended consequences are better understood than with the first EO. Get the wording right so that the execution can be done correctly.

Part of this is understanding that he is not running a family business so hopefully it's a learning experience.

Hopefully it will help having a Justice Dept instead of the ragtag bunch that represented the case to the Circuit Court. Fingers crossed.

edit: and drafted the Order in the 1st place.
