I'll admit it, I'm listening and he's earned my respect for standing up to these bullies. Ramsey, Jurich and Pitino have suppressed any voice of dissent for too long, this is long overdue pay back. I live in Louisville and this picture sums up my view on those three, we know how that ended.

He is doubling down on the "rogue" defense. It is his last and only play in his pitiful attempt to save his "legacy" (but likely not his job).

Surely Pitino has someone telling him to leave this dumpster fire. He has nothing to gain by sticking around. Even if he didn't know about it, there is now a stigma placed on UL bball and he is going be held accountable as the head coach. I think his ego is telling him this isn't something I can't handle, and I'll lead UL out of this mess.

As this situation at Lil Bro continues to unwind....I'd like to get the opinion of the legal gang as to the University's civil liability exposure...as it pertains to the underage recruits.

With a University staff member paying for illegal activity to be used in order to recruit the "minor" does that expose the University to civil damages if an angry parent decides to file suit against them.

It would seem that an official university recruiting visit where your son is illegally serviced in order to get his commitment to play....would expose the University to huge civil damages.

How realistic is this angle and the possibility of lawyers taking this approach to mine for a payday?


First, you have an issue of sovereign immunity, meaning that a state entity cannot be sued.

Second, even if you could get past that hurdle, you would have to claim that McGhee was employed by the university. I'm not sure a graduate assistant would apply.

Third, the university would argue that McGhee was acting outside the scope of his employment and therefore respondent superior (legal term meaning that the employer should be responsible for the actions of its employee) would not apply. They would argue that he went rogue.

Although I like where your head is it... it would be VERY difficult for any action against Louisville. Just my 2 cents...

if true, the guys in Indy will appreciate that....

It wasn't the NCAA, it was his lawyers and UL's lawyers. Why would the NCAA ask him not to say anything about it?

A guy called into Matt Jones today and said the he was a bouncer at 4th street live and helped McGee get players/recruits into clubs. He said that he personally attended the UL *****/stripper parties and wants to talk. Matt took his number and wants to check out the story. This should be fun if legit.

If Pitino tells the NCAA he knows nothing about it and it turns out that he did know what was going on. Does this bring the death penalty to the university? I really don't care if anyone answers this, I just wanted to have a post in the best thread ever.

The captain is always responsible for the ship unless you're on Louisville's boat, then it's every man for himself. Pitino has not showed one iota of responsibility, just lawyer rehearsed commentary. And Jurich, the mastermind of corruption at that school would have shot up the ladder working for Capone.

If Pitino has to go, so be it. But I hate it because we have done so well against him......yes, I sound selfish, but this is the type of allegation that was needed to take him down.

I have heard on Colin today, Pitino is pushing his name all over the networks trying to get a guaranteed slot on TV very soon.

Saw that. I like Bilas as much as the next guy, but he's been an ACC homer about the UNCheat stuff, and the past stuff with Duke (Thomas, Maggette). And the men's bball program absolutely were named in the allegations. Not Williams, but basketball was. Don't know where he got that they weren't.
A smart lawyer, but Bilas has been absolutely unbelievable in his defense of UNC basketball. I just shake my head every time he's asked about the UNCheat scandal.

Right. May get personal liability on McGee. But probably cant get into the UL pockets due to being beyond the scope of employment. This all assumes the money isnt eventually tracked to a one of McGee's bosses.

What about as director of basketball operations? He had that title I think.

The Athletics Dept. Does that have that same sovereign immunity? They were sued recently over a sexual harassment case and lost involving a past women's AD. Is that different because both were employees?

Could they sue McGee personally then? Get him to roll over on his employer. Does that change things in any way.
