When no collusion is proven they will simply switch their charge to "conspiracy to collude". (he wanted to collude, but just didn't have enough time before being elected). Still intention to collude is just as bad as actual collusion, so he colluded even if he wasn't able to fully conclude his collusion because he had to collude to plan the collusion even if the collusion planning didn't actually lead to fully provable collusion.
