Jane Doe and her husband separate.
She asks if you would mind being a reference for a job and you agree..Name and phone number given to her.

Get a call the next day from some car title loan company...your signature has been forged on a contract..the company agrees to remove your name from that bulls&*t.

Confront Jane Doe at her house..she starts crying..her ex took out a line of credit on the house for $150,000 and fled to Europe with the money..me and my kids are going to lose our house..etc etc..

What would you do?

Yes. I assume you still own the house so the guy has defrauded you too. In order to have any chance of restitution, you need to go through the proper channels. All this started with your forged sig. Keep in mind, I'm no lawyer. Good luck.

my name was only used to get a small loan on a Mustang..I'm out of the picture but she still commited a crime..

I'm leaning on just letting it go since I'm not damaged..just shocked..

I am a lawyer; I believe from your facts that a few crimes have been committed (forgery, fraud, obtaining money by false pretenses). The decision to prosecute is up to the State or Commonwealth; however, practically speaking, the Commonwealth's office or prosecuting attorney will never hear about this unless you or the title loan company bring it to their attention. On one hand, it seems as if you won't have any continuing liability if the title loan company has taken you off the loan; thus, if you would choose to bring this to prosecution, it would seem that you'd be doing so in an attempt to punish her, set a precedent, or feel as if its your civic duty. If you can live and let live, your life would probably be easier not getting involved in the ramifications of felony prosecution--hard feelings, spite, publicity, chance of kids losing their mother when dad has already flown the coop, etc. But you do have the right to request prosecution because from your facts what she did is in fact illegal; if you choose to seek prosecution, you're justified in doing so. If you don't, I would make sure you had written assurance from the title loan company that you were discharged from the debt/contract and make sure there aren't any other instances of forgery or fraud. Sorry this happened to you; good deeds rarely go unpunished.

that's just wrong..her ex is a dk..run off with all of their equity and leave two kids behind...I'm over my initial anger...and since I'm not on the title loan for their Mustang, which I'm sure will be repo'd in the near future..I'm just going to try and let it go..

What state are you in?
NC..funny thing is three neighbors to the right of my house are lawyers..Duke, UNC, and ECU..I haven't had a chance to talk to them...if that company hadn't called and she had made payments on time..I would have never known about this.

I knew you were...I could have handled it better and tried to take emotions out of the equation, but I've never handled stress as well as I should..I was pretty bad on the phone with the woman from the company...

Oh, that sucks. I don't know what I'd do. On one hand, I REALLY hate the sneakiness and dishonesty. On the other hand, as long as you are 100% sure that everything is out of your name, you really have nothing to gain by pressing the issue. I honestly don't know what I would do. I guess it depends on how she treated/currently treats me, in general...

I barely knew them.. ..I don't think she had any intention of defrauding me.. just desperate..hadn't made a mortgage payment in three months, or so she said.

Yah. Desperate people do desperate things. It would be easy for me to say that I would never do something, but until you are in the bad situation, you never know...

To be on safe side, with credit agencies in the future, I would demand a hold harmless letter, notary, from both parties. Just in case the notes are factored and some shyster ends up with the paper with your name on it. Would like letter on letterhead of the lending company.
