Entered the transfer portal in April
My apologies. The way it was worded on KSR made me think the situation was similar. But that will do it.
Means nothing really. It's not the spirit of the rule and they are just being stubborn to make a point.
This guy entered the portal back in the spring is the only difference but one the SEC is trying to make a big deal about.
The SEC is acting as if relenting on one rule will place all rules in jeopardy. The court will likely give them an assist on that. And, maybe that is what the SEC wants. In a past life I represented therapists who would seek a court order whenever third parties requested medical records for litigation. The court order gave them a measure of protection. A court order here gives the SEC an excuse for variance from the rule.
It should be easily rectified. You can't punish a guy for not entering the portal in April, when you made it clear he wasn't eligible to return to college.
The ignorance of Sankey and The SEC, is astonishingly bad here.
