So Fenwick wins on Wednesday morning, what will everyone say when PFN appeals the decision and there in no 7A game on Saturday?

If I'm PFN and I lose on Wednesday I would 100% appeal the decision.

On this we find common ground this sucks for the Kids and the refs. The IHSA had a chance to correct this on Saturday and elected to hide behind nonsense Bylaws with selective enforcement. Look at page 7 of the Form 990 to see how absurd some of these political HACKS are paid. The form filed January of 2016 is for 2014 while Marty Hickman was still on the payroll in retirement with compensation of $581,534 plus $11,421 in other comp. He averaged around $300k over the prior 4-5 years and salted away a ton of deferred income for retirement. All this income while managing a paltry $11MM/year organization, this makes me want to PUKE! Tell me this isn't a politicians package??!!!

My guess is if Fenwick wins IHSA will appeal drag it out and the games will be played on Saturday

The result of an appeal, I would expect, would be an injunction that will postpone the game until it is settled, which will take longer than many of these kids will still be in school. No winners...I feel bad for ESL.

I foresee no 7A game. If IHSA loses they won't hesitate to cancel 7A like AA wresting in '95. Flyers rueing the day they petitioned up from 6A

Should Fenwick prevail in court, the ruling will likely place an extraordinary burden on the IHSA to carefully re-examine its current rules and amend them if needed, particularly altering the outcome of contests when overwhelming evidence is unearthed indicating human error.

This is, however, the IHSA: In the event the court rules against it, they will likely cancel the 7A title game and seek refuge elsewhere on members' dues.

I can imagine during oral arguments on Wednesday, IHSA officials and attorneys will blow bubblegum and roll their eyes in contempt of the suit.

I do imagine that the IHSA attorneys cannot be happy with the press release from Saturday night essentially admitting fault and negligence. My guess is that no one ran that past the legal department.

Lawyers on the board help me here, Fenwick pays dues to a private organization and somewhere in the by laws I'm sure it says all IHSA rulings are final how do they get around this?

What is the legal argument would they use?

They are using a "once-in-a-lifetime" opportunity which could pass and cause irreparable harm. Very weak legal basis, but I will take anything to see the IHSA cowed.

No disrespect, but when have you ever witnessed the IHSA do anything with a careful plan? The IHSA expects Fenwick to bear this injustice with fortitude.

I'm going to LOVE seeing the IHSA get the pitchforks-and-torches treatment.

Judge Kennedy is a terrific judge. I have a status hearing on 24 at the DC that Wednesday. May need to sneak up to 25 for arguments. I can't see Fenwick winning this Motion, though. However, Judge Kennedy did slam the city in the red-light speed camera case.

yeah - crazy they allowed that statement to be released. Either they made an error on that by not running it by Legal - or they feel it doesn't matter that they admitted the fault because they feel their decision and authority can't be reversed/questioned in this matter.

Could they delay the 7A title game until December and play it then assuming a ruling in Fenwick's favor and an appeal is heard expedited the following week?

I fear that since each member school "volunteers' to be governed by the IHSA, that the courts will say something like "you agreed to be governed and abide by this IHSA governing body and if you don't like their rulings or how they operate, do not agree to their oversight" ....or something to that effect but in Legalese....

In a non legal (apples and oranges example) If you agree to binding mediation,.. you can't then go back to the courts seeking relief because you didn't like the mediation outcome.

It's irreparable harm the injunction, in theory, prevents. If you move forward, there is no way to remedy. It's just a time out. I'd assume cook country judges and the legal community could move this quickly to resolution ... I think.

PN coach was asked on the media conference call today. IHSA cut him off before he could address the direct question asked of him by CBS 2.

I can't imagine Fenwick playing ESL. That would put ESL at a terrible disadvantage. They have been preparing for PN all week and I'm sure Fenwick has been preparing for ESL. 3-4 extra days prep for a team is a lot.
