After reading through the Moore lawsuit........

It would seem that "Coach Cohen" and Mr. Nesmeth should be hauled into the public square and placed in stocks.

The Oxford attorney Mr. Foster seems to have uncovered a vast and deep conspiracy to deprive this innocent young man of an opportunity to make mucho deniro in MLB. Not to mention that Dr. Linton is an incompetent physician.......

Perhaps rugbdog and riverdog can testify in Cohen's behalf that he was too stupid to be part of such a complicated and sophisticated scheme........

*Edit to add; this is a perfect example of why we need 'loser pays' in this country for these types of lawsuits. This will end up going nowhere and costing MSU and Cohen legal fees and some slimey Oxford Lawyer will get his kicks and a few bucks for his meddling from the Moore's.

current players that he was decreasing their scholarships. This would be simple to prove and I am going to assume that some of that took place. What I don't understand is why. Someone in the 10% explain why Cohen's 1st move would have been to decrease their scholarships other than the fact that most of them sucked and didn't deserve the scholarships in the first place.

That's something some dumb *** backwoods high school coach would do...bush league. Maybe it's a good thing this lawsuit came up and exposed his ways even if it goes nowhere. There is no excuse to ruin a player's health like that...regardless if he sucks and don't deserve a scholarship. I'm not sold that it's completely true but it wouldn't really surprise me all that much to be honest.

It was not like Cohen started and had a line of guys that were talented and waiting to play but could not get a scholarship. He had the current players and their scholarships were set, once he decrease or pulled part of their scholarship, where did they go? New recruits coming in? I would assume that was the case but I was just looking for confirmation.

these are my thoughts afterbriefly scanning the complaint.

1. They make multiple allegations that Cohen caused the injury to Moore's arm, but never a establish a cause of action to that effect. An action based on the injury itself would be much more lucrative for the Moore and his attorneys.
- which leads me to believe they can't prove Cohen's actions were negligent to the extend they caused the injury.
2. Scholarship is a one-year contract, no law mandates it be renewed the following year. Moore's breach of contract claim is bogus.
- which completely undercuts the merits of this case. He had no "right" to a renewal of the agreement. (he did apparently did have a right to written notice and a hearing)
3. They blame Dr. Linton for the arm injury, never a establish a malpractice cause of action, which would entitle the plaintiff to significantly more damages.
- which means he can't prove the good doc was negligent in his diagnoses.

Note: I'm sure some waivers are involved with regard to college athlete injuries, but usually negligence could defeat those waivers.

My Concerns are:

1. The extra practice allegations, the NCAA loves this, they can just wait for the evidence to come out in court and never get off their asses.
2. Moore had a right to notice and hearing regarding his non-renewal, it will be interesting to see if Cohen or the Athletic Dept. can produce some kind of letter or documentation. I am unclear what sort of remedy could be in order

this is perfect example of why we were in the shape we were in when John Cohen got here and started to reverse the actions, and move up back into a winning program..we had too many of these players who thought themselves "special" and deserving of special treatment...it is obvious this year the Coach Cohen has turned the corner and although he is not there yet, we are on the way...hope this case gets the action it deserves and that is for some fairminded judge(unlike the attorneys involved) to send this to the trash...the idea of serving Coach Cohen on the field at TSUN tells us a lot....

Here is another exhibit as to why I complain.

The thing about the extra practice- I noticed that they said that Cohen "covered it up". Which tells me that they aren't going to be able to get anything out of this.

it doesn't get dismissed, actually goes to trial and some of the other Polk players back up the practice claim. Cohen was rough on the players he inherited. I hope it doesn't come back to bite him in the ***.

All that said, I bet it gets dismissed.

There are a few good ones around, and I work with some of those. Overall, it is a despicable profession and I completely despise 97.3% of the MFers. And I don't give 2 ***** what those that hang around here think. So don't bother.
