It always was. I'm sure that's why IHSA punted in the first place. They had a plan, submitted it, waited, waited, waited... and finally got approved. AFTER APPROVAL, they changed it (for science). At that point, the IHSA realized that it didn't matter what they did, JB and friends could and would change it at the last second (even without any changes to curves, etc.).
