Also, this is an aggregate, not showing showing rolling average. The Dakotas actually started pandemic with very low infection rate, so using chart as evidence of trend will cover up how bad it is there right now.

None of those states are in the top 10 "deaths per million population", which NY and NJ lead as well.

Cuomo's murder count is up to what, 6000 or more? Nice governing. Greatest mass murderer in US history.

Sounds great but is actually very counterproductive for their goal.
If their goal is to prevent people from dining inside I’d say it’d be pretty conducive to their goal. Not sure what legal power they have to do anything though.

So you don't want to be ranked higher if it's not high enough.... got it. I'd take $3000 more per person on income and a few spots higher on education and healthcare.

So if a business doesn't follow the guidelines, are they open to lawsuits if someone gets severely sick or dies?

Does that count for Amazon, Walmart, Lowes, Kroger... etc etc? Or is it just small business that we are going to hold to some really weird standard of safety that we've never done in this country before?

Pretty sure people sue those businesses over slip and falls if they didn't take reasonable steps to insure public safety.

Think it would depend mainly if they can trace it back especially if it is a large amount of cases "super spreader event."
If a business owner doesn't clean up a known spill on the floor and a customer falls and injures themselves, it can be a basis for litigation.

We may have those types of cases arising before this pandemic is over.

If I was going to disregard the mandates or even federal guidelines, I'd have customers sign a waiver knowing the possible danger.

We are talking about covid. If both businesses are open during covid why would one get sued, and the other, it isn't even a thought? Your question implied a separate standard.

Yes we are talking about a possible safety issue, Chipolte's and Blue Bell was sued for making people sick. I think that would depend on the guidelines set for that the of business. e.g. no waiting rooms in barbershops and salons. I didn't make the regulations, bub.

exactly. If Andy were at all practical, he would have announced this a couple of weeks ago to give businesses time to prepare and run their inventory down. The timing couldn’t be worse as this is one of the busiest times of the year for restaurants.

I understand the goal of the restaurants, and it breaks my heart, but rarely do those type of protest accomplish what they're trying to achieve. It really just gives him more ammo for 4pm.

The real exposure businesses face is from federal and state OSHA. They are citing businesses for failure to follow guidelines, and don’t necessarily care if they can prove an exposure actually happened in the workplace versus elsewhere. If an employee gets sick and the employer was not following guidelines, they basically presume the exposure was occupational. Or at least that’s what I’ve seen lately.

Then you have the issue of your workers comp carrier potentially denying coverage if they find you willfully ignored safety standards. It’s just a ***** of an environment out there for employers right now - even for those trying to comply with the standards in good faith.

As a household that owns two businesses just saying “F you” to government “suggestions” is not going to work. Besides all the lawful and agency issues a huge issue is the fact that some or most of your employees will be in favor of the restrictions or will be scared themselves which will cause a mutiny and the employees themselves reporting you. In the restaurant example you guys are using you’re acting like the servers and bartenders are gonna be “f ya let’s stay open!!!” I can assure you they aren’t, actually a large percentage if not the majority will themselves agree with the mandates and it will be a “poor employees versus the money hungry selfish employer forcing the staff to risk their lives” situation.

While not a ton of people, most restaurant workers I’ve talked to or seen interviews from are pissed they’ve been following all the guidelines and Andy is still taking away their jobs immediately before the holidays.

Had this very conversation with a few in NKY on Wednesday night. Surprisingly they’re willing to risk catching a cold so I can risk a cold and buy food from them, and they can in turn buy christmas presents for their children.

Oh well, I’ll just drive 5 minutes to Cincinnati for dinner tonight where covid only gets you inside a restaurant after 10pm and before 5am.

To me this is the most vile part of what he did. He knew weeks ago he would do this. You could see him laying his foundation for it weeks ago.

The case reports are 10-14 days behind. He waited till he knew a big dump of jail case reports came in (just like he did with masks) before making his move. And to not roll it back to 33%? Just close altogether? Brutal.
