We are talking about covid. If both businesses are open during covid why would one get sued, and the other, it isn't even a thought? Your question implied a separate standard.Pretty sure people sue those businesses over slip and falls if they didn't take reasonable steps to insure public safety.

I understand the goal of the restaurants, and it breaks my heart, but rarely do those type of protest accomplish what they're trying to achieve. exactly. If Andy were at all practical, he would have announced this a couple of weeks ago to give businesses time to prepare and run their inventory down. The timing couldn’t be worse as this is one of the busiest times of the year for restaurants.
