I vaguely remember State sending a letter to some school in 2017 after that school announced they would be building a new "Left Field Lounge". Don't recall which school it was, but I think it was in the Big 12?

Anyway, a lot of people laughed that MSU would claim trademark rights, but the school in question changed the name of its expansion to "Left Field Terrace".

They scrubbed it pretty good. I googled “left field lounge Missouri” and the first reference was way down the list. That makes me think it’s trademarked.
Although for a long time that wasn’t even the official name of that section at DNF. The passes used to say “outfield terrace”.

The announcers on tv last night were lamenting about how great left field lounge used to be and how now it seems that State sold it out for money to make sky boxes. They said it just wasn’t the same anymore
. That's not what I heard them say.

I did hear them talk about Mississippi State being the first to have a left-field lounge. I did hear them say how unique it used to be with the individual rigs, but it was more in reference to how it all got started.

I did not Hear them say anything negative about the current set up.

They were very specific that it is no longer the same, in that the original was better.

And in a lot ways the original was better, mostly bc of it’s quirky uniqueness but the new setup is really nice and you can put in things to make it uniquely yours while being much safer and easier to walk around in the Outfield.

The original was more unique and definitly had more character but I like the new one better. With the original you had to be on a rig to see the field, with the new spaces you can actually walk around and see the field from anywhere outside of the batters eye. The original LFL made the engineer in my absolutely cringe.

I looked it up, there's no active trademark... There was one for an apparel company, but it's expired.

aTm would have likely buried the barners by the end of that inning in a lawsuit. Hell, they are probably trying to figure out how to get us to start using pink and green instead of maroon and white.

We had lots of discussion about it back then. To the best of my knowledge, the school has never filed for federal registration on the trademark, but still considers it a trademark. Common law trademarks are enforceable just like registered marks, you just gain some advantages with registration.

Back then, though, State had a web page with a list of its registered and common law marks, and "Left Field Lounge" was not on the list. Doesn't stop them from claiming rights in the mark, it's just a little embarrasing, and would look bad if there was ever a trial over it.

One problem is identifying the goods or services associated with the mark. To be valid. A trademark has to be used in connection with an actual sale of goods or services. What does State sell that is labeled "LEFT FIELD LOUNGE"? T shirts or mugs maybe? Are any tickets labeled that way?

Interesting angle to it and I was not aware they simply claimed and there wasn’t per se a federally registered trademark on it. Now if THAT doesn’t scream MSU…

There's lots of marks out there that are not registered. Ive been involved in litigation over several.

Whenever you see a label with "tm" on it instead of the "R" in a circle, that means the owner is claiming trademark rights without registration. Sometimes registration is pending, but not always. If there isn't even a "tm", then the owner probably never talked to an attorney, but they can still have trademark rights.

The bigger problem for "Left Field Lounge" is whether MSU has even used it asxa trademark.

I think Missouri backed down just because it was the right thing to do. And why risk litigation when it's so much easier to change the name?
