I'm sure there are several Ole Miss lawyers out there that would like to make a bigger deal out of the "cowbell assault" issue than it really is. But, I'm not so sure they are the party that should be trying to outlaw "dangerous" tradition. Remember, these are the Ole Miss Rebels. What goes around, comes around.
Do you think those same lawyers would be willing to take on a case to force the University of Mississippi to give up the name "Ole Miss" and "Rebels"? After all, I'm sure there are at least a couple of folks out there that have encountered enough emotional pain and suffering (whatever the legal term is) brought upon by the names and symbols representative of an offensive past. The University embraces these name regardless of how offensive it may be to others. Would those same lawyers take up for those hurt by the offensive symbols of the University? Or, is the physical pain from the gash caused by a cowbell far greater and more important than those hurt by the inconsideration of our neighboring institution?
If MSU could be held liable for an individual's assault on another with an object not designed to be a weapon, then certainly the University of Mississippi can be held liable for the emotional pain and suffering caused by their careless flaunting of potentially offensive confederate and old south names and symbols. No?
