he was definitely on the rubber before he threw thats his foot being drug off as he throws the ball which happens with every pitcher as their momentum takes them towards the plate.

Perfectly legal, when striding towards the plate you're taught to actually shove off and pretty much lunge towards the plate. Your foot doesn't have to stay on the rubber throughout the motion

This. No rule that states you must maintain contact on the rubber as you are pitching. The rubber is there as a method of declaring "what you are." Legally coming into contact with the rubber before the pitch means that, by rule, you are a pitcher. Not toeing the rubber or (legally) disengaging your pivot foot from the rubber means you are an infielder.
