BOT Subcommittee Voted to Remove Barry Fenchak from Alumni Trustee Ballot

Think this is worthy of it's own thread, since the other thread that Barry stated today was in anticipation of what would happen.

They screened something like 19 candidates that met all of the other criteria. 18 were included, but they voted to remove Barry from the ballot.

I said in the other thread on this...

I believe it ended up being 19 candidates that they reviewed. 16 of them were added unopposed. 2 were objected to due to lack of experience, but they didn't have the 2/3 majority to strike them down (Jay voted to keep both of them on the ballot, Ali voted against one of them). And then Barry was the one removed. The optics of this are horrific, but it seems that the BOT answers to no one, and does whatever the hell they want without fear of consequences.

Really not sure where to go from here...this one really is a complete disgrace. I'm not a PA resident so I don't have a congressman to call. As an alum of PSU that has given my fair share of $, has a wardrobe consisting of more PSU stuff than anyone i know, spends a lot of time rooting on and supporting our sports teams, etc, this strikes deep. The BOT doesn't like one of the Trustees, so they come up with new by-laws and find a way to remove him? Hell, I voted against Barry the last go-around, so I'm huge from a Barry supporter. But I am a big supporter in lowering costs, transparency, stopping the "ole boys" network that's running things, etc...so Barry would have gotten my vote.

This really might have been the final straw for me with my alma mater. Absolutely disgraceful that this committee of 9 gets to decide who I'm even able to vote for to represent me. Unfortunately, 95+% of alumni don't know or care about this...but I'm completely shocked that it could really come to this. Any chance that existed of me sending either of my kids to PSU just went out the window today.

Anthony Lubrano asked questions about how they even decided who would be on the committee. They told him that they got input from each of the trustee "groups" (B&I, Alumni, etc). And when Anthony questioned how they got input from the Alumni Trustees, they said that they talked to the trustees for ideas. When Anthony pointed out that no one asked for his input, the Chair suddenly forgot who he talked to so that he could get input.

Barry wanted to talk, but they wouldn't allow it since "only those on the committee could speak" when going through the candidates...and asked again to speak, at the end, but was ignored.

Just a complete @hitshow, and a real black eye to any type of Transparency at PSU.

I agree... it's despicable. Those who care and you are right not many care need to call their congressmen and complain. It's unreal what the PSU BOT has become which is basically a bunch of thugs strong arming their will on any and everything. Alumni should be outraged but alas not many care about their alma mater. They have graduated and don't want to get involved in the politics, just go and enjoy sporting events when they want. Maybe the rest of us shouldn't care either and move on. It's a shame what has become of PSU and the back room politics so the hogs can keep feeding at the trough.

Was going to ask how they determined someone’s qualifications to be on the ballot - was there a questionnaire? If they did not know Barry personally, what criteria would they have used to deny his eligibility?

Everyone needed 50 nomination votes (this was lower from the previously higher threshold), and then the verified that the candidate was eligible by being a PSU alum, not currently or in the past 5 years was employed by the University, etc. Then the committee reviewed things like a "resume" that the candidate submitted with their past experience, a background and credit check, etc.

On the call yesterday, they first went over the number of candidates that initially met the 50 votes, and then explained why a few of them were ineligible (one pulled out, one was an employee of PSU). Then they asked if there were any questions before they started the role call on candidates. That's when Anthony asked his questions about how the committee was determined.

As they went candidate by candidate, they asked if anyone objected to the candidate. Two of them had objections where a committee member stated that they didn't think the person had enough relevant experience. They asked if others had thoughts, and no one spoke up other than to second the objection. Then did a roll call of the 9 members of the committee. With Barry, the person that objected brought up that he were 8 incidents in which he was sanctioned on his time a as a trustee, and specifically brought up the incident where he used the "penis" line from A League of Their Own. Barry raised his hand to speak, but they said that only members of the committee would be allowed to talk. The person obviously was reading off of a prepared statement. Then, they took the vote and everyone other than Jay voted Yes to remove him.

After they finished, Barry again raised his hand, but the committee chair ignored it and ended the meeting.

The Legislature is the 'key' - someone must present a Bill to have the PSU BOT reformed. The premise of too big (number of members) and totally outdated for today's business climate - must prevail and be passed and signed. Otherwise the concept of discourse will be ignored and student costs will increase. (I believe Purdue has a Board of 9 members - refreshing!)

BTW - the Pres of the BOT (David) will appear at the Naples, FL alumni lunch on March 12th - would love for additional support to question Dave.
BTW - Russ Rose will also be an invited guest at the same meeting.

Yes they appear to be idiotic fools....but they are devious wolves in their clown clothes safeguarding their position, prestige, and power.
And our General Counsel, Tabitha Oman, seems to be following in Cynthia Baldwin's footsteps.

Now maybe the legal eagles here on McAndrew can correct me, but I was under the impression that the judge's protective order from October 9th was still in effect? Because he told Penn State on January 29th that it was still in effect and would remain in effect until he decided it wasn't in effect? (source for all this, Fenchak's really good website, under Legal)

So now Penn State seems to be in contempt of court. If Tabitha conspired with Kleppinger to do this end-run - as was pointed out above, if Barry isn't a trustee on May 10th then his lawsuit is moot and will be dismissed - that's RICO, right?

Why is it that the evildoers are always so dumb? They come up with these elaborate plans to gain/retain/abuse power, and then they're foiled by down-to-earth common sense thinkers, just like in the movies. All along, if the BoT wanted to control the educational universe for their own personal gain, all they needed to do was hold a ceremony at which attendees could merrily lap up their cones of Peachy Paterno, in which they renamed the school as Paterno State University, and they would have completely avoided any and all inquiries into the appropriateness of their actions. Instead, they acted in such a manner as to continually poke the Scooby Gang bear, and now they've been unmasked for their evil deeds.

This f’in BOT is so screwed up. Putin approves and will no doubt be elected to our BOT.
