The law does not require intent. Please show me in the statute where the law requires intent. You know why it doesn't? Because we want classified information to be highly protected and we want those that possess it to know that they have to use all precaution to protect it, even if they accidentally disclose it. The law if very simply. BTW, Comey is not a prosecutor. He is a cop and it is not his job to determine guilt or innocence. That is up to the DOJ.

Comey makes recommendations to the DOJ. They can take it or leave it. Obviously, they (DOJ) have decided not to prosecute. I'm not excusing what she did. They (DOJ) know they don't have a winnable case.

BS. The statute is clear. Intent is not required. Soldier in prison right now has no intent either but he isn't a connected politician.

Where do you see the word and intent? Coney made it up. The statute is as clear as it could be.

You cited Section 793, Gathering, transmitting or losing defense information, which was originally intended for espionage and really isn't the most pertinent Section of Code for Classified Information, it deals more specifically with defense information. Section 793 also requires gross negligence.

The kind of information doesn't matter. It was classified and handled in a negligent manner. This is a no brainer. Even a Dem Senator, as I posted, is calling for a special investigator to look into Huma's activities.
