I agree with you on the USSC decision on eminent domain, but I'm not sure I agree with respect to the building of oil pipelines. With respect to the one we wanted to build for Canadian oil, what do we get out of that build - short term employment for folks building it, but what long term economic effect? After the Kelo decision when the Supreme Court basically said that the city could take away private property from one person and give it to another person because they had better use for that land. What a terrible, terrible decision. At least eminent domain in this case is for public use and perfectly legal and legitimate.

Number one, pipelines are the safest means of transportation for fossil fuels. Secondly all transportation revenue is taxed Based on the net profit ability of a corporation transporting that oil. Thirdly the profits from the wells that drill the oil to transport it are taxed. Fourthly, the oil and gas industry employees millions upon millions of workers. So to find, explore, drill, develop, and transport oil and natural gas not only employees millions but generates enormous tax revenues.
That doesn't make it public use. I could claim I want to put up a new corporate headquarters building and make all of those same arguments but that doesn't make it public use.
There may be another facet but none of your statements make it public use.
Eminent domain has frequently been used in the past to support oil and gas pipeline construction. This is nothing new. And with the Kelo decision it makes it extremely easy
Kelo essentially allowed a public entity to take private land from a landowner and sell it to another private property owner because it provides greater economic benefit to the community. A ridiculous decision but one that is the law of the land.
You have an odd way of admitting your wrong. Just post 'I was wrong' once in a while. It's freeing for the soul.Once the project is approved, they can use eminent domain. Pipelines for the most part are considered to be like rail lines and considered to be in the public interest.

I agree and I see it used all the time. Not a fan of ED. There has to be a REAL damn good reason to use it, better than an oil pipeline.
