Trump has created no additional powers for governors. Their powers are often broader than Presidential powers under state constitutions and laws, especially in times of emergency. They retain such traditional powers as they would have held under colonial rule and the brief period of the Articles of Confederation, pursuant to the 10th Amendment.

Our “federal system” can be confusing: a President can only pardon those convicted of federal crimes; our governors can only pardon those convicted of crimes in their respective states.

The Presidency has emergency powers that are defined by precedent, much of which has gone largely unchallenged at the time of the emergency. Lincoln locked up tens of thousands for more than 3 years in Maryland, without a hearing.

If the perceived emergency is bad enough, the Courts have shown reluctance to address the issue, directly, until the emergency abaits.
