The next time an OM guy comes over here and says "our football players get no preferred treatment!" here's proof that that's ********. Kid gets knocked out, loaded in an ambulance, sent to the hospital for a day, multiple witnesses, and that's not enough to find any wrong doing on DK's, RK's, or any of the other 5 football players?

I am not knowledgeable of law at all so someone please enlighten me. I had a OM homer make the argument to me that it was a civil matter...What difference would that make? Would that make these two thugs any less of a cancer to the football team?

Remember Freeze and staff cheering loudly on ESPN after Robert committed again on signing day? Yea.. He knew about this at that time and while he was gushing in interviews about signing him. What a crooked snake oil salesman. That is pitiful and disgusting.

Battery and intl influction are intentional torts with one year

Civil means a jury only needs to find this more than likely happened (greater than 50%). Much easier burden.

if thier identities should come to light, and have the claim still meet the statute of limitations.

And no wrong doing was found???? I would take a hard look at the investigating agency as well. Based on the complaint this is aggravated assault manifest extreme indifference with basic agg assault being the lowest charge. Could potentially argue successfully a deadly weapon due to the kicks to the head....I know we have argued that successfully in the past on cases of this nature.

Interesting that an investigation yielded...nothing... ??? It's very VERY suprising no criminal charges/arrests were made. VERY suprising as actions like this can cause death easily.

The "investigation" probably went down this way. So Baird's head was kicked in and the ambulance and police were called. The Frat president and execs cleared out the house and made sure no drunks were making a scence to cause the police to come inside the house. Then the police and EMTs asked the president what happened. Well, the president wouldn't know because he was inside the house at the time of the fight. No witnesses to be found. "Investigation" over.

You've got to read any Complaint with a grain of salt. There aren't many Complaints that tell the entire truth. This one is carefully crafted to try and keep the KAs out of it too, so its definitely personal against the brothers.

Just forgetting one thing.... You got a guy on the way to the hospital that can be interviewed later. So the key to killing someone is to shoot them in the yard, get rid of them, and then ask everyone to leave? So when the cops show up... There is no body, there is no witness, and you got a guy there shrugging their shoulders.. And they close the case?

Thats weak and really reaching.

by the way. I see what you did in your post. But this party line is going around in damage control

Sure you do. It's not like you are going to volunteer information that doesn't make your case. But that is pretty damning. What is the claim that can be made to counter that? the defendants have no medical records, supposedly, to claim defense to aggression.

The worst case scenario for the defendants is that someone did say something to them and they jumped on the plaintiff thinking he said it. What is the defense to that? Especially given the medical evidence.

and the guy was out cold. If you don't know what a sternal rub is, ask a nurse to give you one and I promise they will give you one. No response to that means you are in la la land.

the plaintiff has witnesses, medical records, and a damn good lawyer. The defendants have leaving the scene like a pack of stray dogs when they hear a gunshot. I don't know what the UM fans see when they claim nothing will come out of this.

The funniest part about this is how the ole miss fans seem to be proud of the fact that one of their football players actually won a fight against a frat guy this time. Even if it was a sucker punch.
