JEFFERSONVILLE, Ind. – The Indiana Attorney General’s Office has reached a final settlement agreement with three former board members of The Harbours Condominiums Association in Jeffersonville, resolving a longstanding dispute that involved allegations of fraud and financial mismanagement by the defendants.
The settlement agreement bars Kevin Zipperle, Mary Lou Trautwein-Lamkin and Sharon Chandler from serving as voting members on The Harbours board for at least two years, requires Zipperle and Trautwein-Lamkin to pay $2,000 to The Harbours Condominiums Association as restitution and requires Zipperle to transfer two parking spaces that represent thousands of dollars in market value back to the association.
The settlement agreement is a resolution to thelawsuit filed by the Attorney General’s Office in 2012, alleging that the defendants were using their positions of trust and authority as Harbours board members to make financial deals with association money that promoted their own best interests to the detriment of the other association members, without other members’ knowledge or approval.
When The Harbours dispute initially emerged, Attorney General Greg Zoeller said it brought to light the fact that members of homeowners’ associations had little recourse available to them to recover their funds in the event of homeowner association fraud, outside of expensive private litigation.
Largely because of The Harbours case, in 2011 the Indiana Legislature granted to the Attorney General’s Office authority to investigate and take action on allegations of fraud and misappropriation by homeowner’s associations or similar entities. This legislation was expanded in the 2015 legislative session to make it easier for homeowners to obtain financial records from associations and to allow for additional penalties in cases of wrongdoing.
“Residents place trust in homeowners’ associations to properly utilize community funds, as they would a government entity or a nonprofit,” Zoeller said. “Members of homeowners’ associations should know how their dues are spent, be able to access financial records and have an avenue to correct fraud if it occurs. Similar to its oversight role of nonprofits and government, the Attorney General’s Office can now assist when trust is abused in this way.”
The Harbours case was the first time the Attorney General’s Office used its new authority to uphold transparency of homeowners’ associations and hold bad actors accountable. This authority is in line with the mission of the Attorney General’s Public Integrity Coalition which aims to reduce fraud in government as well as the mission of the Attorney General’s Consumer Protection Division to protect consumers against fraud and deception.
Members of homeowners’ associations who believe fraud is occurring can contact the Attorney General’s Office for assistance by filing a complaint online atwww.IndianaConsumer.comor calling 800-382-5516. This year, 88 such complaints were filed with the Office.
The settlement agreement reached between the Attorney General’s Office and the former Harbours board members was initially approved by Floyd County Superior Court Judge Susan Orth, appointed as special judge in these proceedings, in August. The agreement was modified in December.
Zoeller thanked Deputy Attorneys General Jennie Beller, Dave Miller and Derek Peterson and investigator Sally Miller for their work on this case.

We are a founding member, why would we leave? We are not a conference vagrant like UofL.They are both full of it. Zipp, from what I've seen, likes to play that they need us more than we need them card. He says the only reason UK stays in the SEC is for the easy basketball schedule. That's totally false and we know it. It's the bottom line, finances, that keeps them there. The same reason that UofL has made the conference moves they have made in recent years. Those conferences give more national exposure and more revenue.
Against one SEC opponent you can make three times the ticket revenue you can with one game at Rupp not counting the higher capacity level of suites in a football stadium. Football is the money maker at most schools. UK would be stupid to leave regardless of how well football is doing, especially being that your basketball program is one that can walk out and schedule anyone they want to outside conference play. You hold the keys as to how tough or how lame you want your schedules to be and from what I've historically seen you guys make them as tough as possible.
I'd make the argument that UL needs you more. If they beat you in basketball it's instant cred because more often than not they'll be beating a ranked opponent. In football it's instant revenue because of the in state rivalry and it's an SEC team that we're beating. Like you all have pointed out the Alabamas, Ohio States, and Michigans of the world have far more on their plates to deal with than worrying about scheduling a home and home with Louisville.

They have had recent success not historic success. We are not much different historically and Tennessee is better than they are and it would not be a rivalry. This guy knows nothing about football. He is simply a pansy looking for attention.Zippy thinks they should replace us with UT as a rival. I'm sure the Vols would be much more excited for that than lousy ole Bama. Although the rosters of UL and UT would have similar looking rap sheets, so maybe he's on to something. That guy is comedy gold.
