Info on AK..

Just spoke with my Ole Miss $$ buddy and he said it was true.
It was four guys in the cab and the argument was over the fare amount.
AK punched the guy in the face and called him a few choice words.

Now some money has been offered with a few comas in there and
the cabbie is going to recant his story and drop the charges.

what the hell is he doing out at 2 AM and putting himself in a situation like that the night before a game? He can go from making close to a million dollars to nothing with an incident like this. And from everything I have heard about Kennedy, this type of behavior is not abnormal.

Why was he out that late?
Maybe he was showing off his old stomping grounds.

AK is a lush, seen it first had at my buddies box at a Rebel football game.
He likes his whisky...

No excuse for what he did, but $$ talks and he will probably still be the coach when all is said and done.

She has spoken w/ the family and they are saying that the cabbie started saying racial remarks about one AK's assist coaches. They asked to pull over and get out. This started a verbal confrontation and the police were called. I'm hearing there were no punches thrown. I'm sure the truth lies somewhere between the two stories. No good can come out of being out at 1:00 am. I don't know what they were thinking!</p>

This is the problem I have with the AK/Ole Miss side of the story because the police report states that the cab driver had a "swollen left face". So, unless he is allergic to verbal confrontations or had a buddy punch him in the face to frame AK then something happened. However, I agree that the truth lies somewhere in the middle.

Who could've guessed three years ago that a story about a head basketball coach in MS getting drunk and assaulting a person would NOT involve Larry Eustachy?

Dental Dawg, I'm not saying you are full of **** and I know this is just what you have heard. I am just saying that the AK/Ole Miss side of the story doesn't explain that part of the police report, and that truth probably does fall somewhere in the middle.

The Kennedy side of the story is complete and utter garbage.

- AK and his buds are in said taxi, cab driver aks them to stop doing something.
- AK spouts off something about Abdula needs to shut up and do you know who I am
- Cab driver pulls over and tells them to get out, verbal altercation ensues with cab driver facing rear seat.
- Cab driver yells something about one of AK's crew.
- AK with the same cocky temper that got his *** kicked at MSU reaches over and hits the cab driver.
- The cab is pulled to side of road with AK crew piling out and lots of yelling, this is where unrelated witness comes in.
- Cops are called, when they show up AK is yelling about how cab driver deserved it. UM Ops Director tries to take the bullet.

I know for a fact that he got smoked in the KA house. My fraternity big brother was the one who did it. You don't want to go upstairs in any frat house and run your mouth. Sounds like he working on a pattern of stupidity.

those involved. The actual proof comes out when witnesses are sworn in and subject to a cross examination to test the veracity of their statements and a jury decides credibility. Police reports, much like accident repaorts, prove nothing. They are not competent evidence.

the officer who took the report probably observed the swollen face, and will testify as to such (which would be the best evidence). the swollen face would only be hearsay if he just wrote in the police report that a witness told him that the cabbie had a swollen face. i'd get it in. that's what she said.</p>

testify. The prosecution could not get eh evidence merely through the introduction of the report. The officer could certainly use the report to refresh his memory and even characterize the report as an accurate reflection of his recollection. But the report itself, is squarely within the definition of hearsay.

perhaps i should've been more specific - the report can come in under rule 803(6). statements from other witnesses contained in the report would be characterized as hearsay, and must be redacted. the facts found by the investigating officer may remain in the report. if he observed a swollen face, that would be such a fact.

you can take your lesson somewhere else.
