So I guess drunk drivers should not be arrested or pursued, as long as the victim wore a seatbelt? Cause thats essentially what you are saying. Criminal Negligence is a law of applicable generality, because there is a diversity of scenarios. Your example: IF someone preparing my food knowingly tried to spread Hep or HIV, that is fkn illegal. A simple google search, or your search engine of choice. You are proving my point. Laws exist to mitigate bad, unethical, or endangering behaviors. To protect us from those who only care about themselves and doing what they want to do regardless of how it effects other innocent people. Maybe that kid was seated in the student section, but maybe one of those students went home after the game after touching something and spread the virus at their parents house. When the parents were safe, they were careful, they made all the right decisions that best aligned with their perspectives. Its not about living in fear and not living life. Its about being able to do those things period, without govnt dictation, control, or someone elses decision putting our lives or family members lives at unnecessary risk. We all drive, we all accept the risk, every time we get in a car, and there are laws that help entice acceptable behavior and protect innocent people. Speed limits, seatbelts, DUI, etc etc.. Free Will & Individual Liberties has limitations. The U.S. law is very clear about that when it comes to negatively impacting other peoples health.
