Florida might also find themselves tied up in Title IX lawsuits like our friends down in Knoxville.
yknow what? They know that - and don't care. Risks of booting super talented receiver outweigh risks of blowback from lawsuits.

Or ask the criminals in Knoxville how devastated they are having to pay off their lawsuit to keep it quiet & make it go away. (spoiler: they aren't at all).

We are always the first to blow a hole in our own foot, when it comes to football.

I'm a fan of coach Stoops, but feel like he should have forced some hands up there. It's either my conduct and incentive based guaranteed contract or this group of nerds on a school boards call but I would have went to the wall for an innocent man........ especially a member of the team I coach.

A true disgrace handled wrong by born again Christian Mitch Barnhart..........WWJD. What would Jesus do? ........ Well let's see I'd have to think allowing a false allegation of rape or any penalty that comes with it stand.

You're way off base here. Neither Stoops nor anyone in the athletics department had any control in this mess. This was a Dean of Students fiasco. Tubman should have sued for lack of due process. He would have won.

From what I understand EC is the only person that could have intervened in the process and stopped it.

I hate win at all costs schools (our two biggest rivals presently) but I also hate being stupid in the advantages we give them for no good reason.

What did Thug U pay to settle out of court (still disgusted that Hart won't have to explain his statement about treating athletes like everyone else when the plaintiff's attorneys brought up the eight thugs vs the average student), and how does it compare to the money that football brings in?

In light of our recent problems on the DL Tubman could have meant the difference in a bowl or no bowl this year, (pretty sure we get one anyway) or even an 8 or 9 win season. Which could translate into whether we sign our five star in state player which also would also translate into a much better group of recruits at the other positions. Also sometimes ONE player can make the difference in a great deal of season tickets AND donations.

And don't base Tubman's value on his play against UK, if he turns out to be very good he will probably be double teamed a lot.

I think his punishment (if any) should have been based entirely on whether he was proven guilty or not, NOT on the "possibility" of some future lawsuit.

VERY disappointed in UK's support of football for mitch's first ten years in charge and now this, if there isn't anything he can do about anything why is he getting the big bucks? He should have paid for CBGs buyout that cost a lot more than it should have because the contract was written on a piece of toilet paper..

I hope he gets 5 sacks against us, maybe even a pick and forced fumble/recovery*. That way we will at least give him a shot at publicity/recognition that he could have earned playing for us.

There is 1 team in the SEC that lloyd tubman would not still be a member of. It just so happens to be us. Sucks.

*but we still win.

Not sure I understand who's dept. is responsible for this miscarriage of justice, but in my opinion it should go far past where we assign blame, and move into the realm of how do we right this wrong. It's painfully obvious that this ship has already sailed. UK athletic department has enough stroke to force hands. Whom even is head of a dept. does not want a scandal of false rape accusation that could destroy another minority's already challenged life, laid at their feet.

Just from my personal opinion, I can tell you I would have fixed this at all cost. The president of UK should have got involved and made this right. If bureaucratic red tape is what you wish to be your legacy than stand aside and soon history will judge you harshly......or you could take the bull by the horns and realize this is an opportunity to right another wrong in a fu€<ed up world. In reality I think it's such a hot topic one is afraid to dig in and get their hands dirty , for fear of dirt somehow rubbing off on them. It's a cowards way of keeping distance from the No means No trend we have been seeing about college campus for years.

I say if your goal for your university is anything short of instilling realistic and honest students who will be educated by quality teachers to be the new generation of professionals your falling short. And if a realistic and honest person can't stand up against false accusations you have created another worthless drone to turn loose in the world. Who ever dropped the ball on this is a chicken **** shameful coward unfit to be a leader . The media should have piled on this case and forced hands to but those fudge packers at the LHL only break a UK story when it rips out our hearts. To help UK would be the worst thing that could ever happen to those people at the Herald Leader,.......and God forbid if a Lexington Cop gave a UK player a break. ....Every other school gets woman beaters ( Miss St. ), cover ups ( UT), judges throw out cases ( Bama) , and the list goes on Florida, Auburn many many more examples, ......but the people in law enforcement and on some board as a student, judges , news papers , would belly crawl through a mile of glass in order to arrest or screw over our players at UK.

Shame on what ever coward never stepped up to clear this for Lloyd, be it Mitch , Mark, Eli or who ever the students are on that so called " board" that supposedly was the hold up. There is blood on your hands, and we know what a chicken **** weasel move this was.

If it is such a no brainer that Tubman should have remained on the team, then why did no major schools (not even the bogeyman U of L) step up to take him? I mean, there are all sorts of "bad" guys out there getting second chances at FBS programs.

Have no idea but maybe it was his choice to go the Peay route.

Not sure why some people are scared to touch this . All I know is if you are innocent you deserve to be made whole, and in my opinion he was not. Unlike the video taped rape by a Vanderbilt player our guy was cleared of all charges and statements were retracted, .....but go ahead and find another team is our proud universities position on this.

We have went from a generation like my Grandfathers who would shed blood on the beaches of Normandy, to weasels who bury their head in the sand in just a few short generations. I hate the cowards who just set in ivory towers and are to scared to even make a statement in the right direction. Nope their move is to keep their head buried in the sand until it's on to the next distraction. When instead we need leaders not scared to take a possible hit in order to do what is right.

Maybe it's a ripple effect that all started from a university not rallying behind this young man to answer this question. Either way it's a true black eye on UK and the people involved who ever you may be. If you had a chance to help and you did not , your a confused person and you will not get help when you need it if karma has anything to say about it..

Well, I've been pretty critical of Mitch in the past, but the Tubman situation had zero to do with him. It was over his authority level as soon as it started. What should have happened is to allow our judicial system to handle the case and UK respect the decision. Instead they turned to an internal kangaroo court which is biased by design and instruction from the Dept. of Education.

No more assumptions than those who are sure that he was completely innocent and the girl totally made the situation up. Also, I think the suggestion that he or anyone else would reject big time offers to play at Austin Peay is far fetched.

It would be a dream scenerio to me to find one bargain in my lifetime as good as this buyout was, and I don't even know what the settlement cost them------I just know all the bad publicity pretty much went away and no one is being called upon to justify it------because it was a no brainer..

Filling a stadium that seats over 100,000 is very important, filling a 67,000 seat one not quite as important or as difficult, filling a 61,000 seat one even less important.

You're partly making our case for us. He may not have gotten big offers. He is a great athlete, with size and speed. Hmm, wonder why other schools may pass on him. Could it be that he was tainted by a corrupt process that didn't even allow him to defend himself? There isn't a shred of evidence to corraborate the girls story, however, there is circumstantial evidence that Tubman is telling the truth. I believe you have your convicted rapist to worry about. You needn't concern yourself with an unproven accusation. You're in a glass house heavily leaning to one side.

So what are you saying he is semi innocent of rape or partially guilty? Seems to me it's one or the other or usually in the legal process ,charges of some sort would stick. When accusations are retracted it usually stops a case dead in its tracks.

Let's put it like this if it were you and a false accusation was proven wrong through the legal process would you want to take half or even a portion of the charges and penalties ? If not then why should Tubman?

No allegations were "retracted". The state decided not to charge him, presumably because they did not believe they could get a conviction.

I've been told the girl backed up on her story from a reliable source. Now a prosecutor refusing to pursue says all it needs to say to most people.....otherwise innocent until proven guilty is a worthless concept ,,and it already has it flaws.

I'm mean the logic used in this deal means anyone can make an allegation and bring a lawsuit and it destroys you either way.

Yes, if you're a male university student. The concept now is guilty until proven innocent. That comes from the all powerful hand of our federal government, specifically, the dept. of education. Sadly, it is almost impossible to prove a negative.

A friend of mine was accused of robbing a bank some 50 years ago. This guy had absolutely nothing to do with the bank robbery, I mean nothing. He had never been in trouble before and was not a problem person at all but he was set up , for some reason, by a crooked cop! 50 years later there were still people who suspected he did in fact rob the bank! Oh he got out of jail after a few days and never went to trial but still he died as a marked man

You do realize that what you describe is true for a majority of rapes?
A small percentage of rapes ever result in indictments because most occur without witnesses and therefore are extremely difficult to prosecute.
The Vanderbilt rape case would have never happened if one of the players hadn't been a total idiot and videoed it and then send that video to a friend. The girl was so drunk/drugged that she had no recollection of what had happened. That evidence was the only thing that saved the day for the girl and the prosecution.

But I'm sure you think that every girl that cries rape but doesn't have video evidence is lying.

So says the man who doesn't know the difference between a jury trial and a bench trial. Yes, folks, that was the Fuzzster over on the Paddock, popping off about that "jury trial" in Baltimore for the Freddie Gray case defendants. Yes, our Fuzzster is quite the legal scholar.

Fuzz should apply his rationale equally to Tubman. When there is consensual sex and a false accusation, the defendant is in the same position of having two witnesses with divergent stories.

The rape allegations where there is a problem often comes from the lack of a rape kit and a delayed accusation. My understanding is that the allegation here included a timely visit to a medical provider. If so, the lack of evidence is more compelling.

Nope, but there has to be something before you start ruining people's lives. You and I have had this discussion before. My issue is the total lack of due process in these kangaroo courts operated by universities at the arm twisting threats from the dept of education. If a guy is guilty of rape, he should be in prison, not kicked out of school. University staffers are unqualified to make these decisions. It is impossible for them to be impartial, the first rung on the due process ladder. It goes downhill from there. You do realize that Grant Neal at Colorado State University, Pueblo, by all accounts an upstanding young man, honor student, preparing for medical school was tossed from school by a complaint from someone who knew NOTHING about the incident. The so called rape victim had a hickey, so a busy body turned him in for rape. She WAS NOT THERE. The so called rape victim told the school she WAS NOT RAPED. Yet, the kangaroo court did what kangaroo courts do. If you support that idiocy, I feel pretty sorry for you. He had NO DUE PROCESS. A university is a state actor. There is no ambiguity in that. I suppose you think it's a good idea to throw our constitution out the window simply because a girl claims she was assaulted? Try the case in a real court with real defense and real rules for evidence and real rights to impartiality and the right to cross examine. Then, the chips fall where they fall. Here, read up on Grant and stay on that moral high horse. http://denver.cbslocal.com/2016/04/19/csu-pueblo-grant-neal-suspension-consensual-sex/

Well, Mr. Wizard, I see one of the problems. You neither understand nor appreciate our legal system. Lloyd never needs to prove she said "yes". You only need to prove your innocence in a kangaroo court. You see, the prosecution actually has to prove your guilt. You just displayed the exact reason why universities should NEVER be making these decisions.

2Adulterers made the claim that the girl should have been charged with making a false report. Others have said the same. To quote him, "The Plaintiff should have been charged with Filing A false report".
I asked for him to make his case. ...anyone to make the case.

If she was charged and found not guilty or No True bill was returned would that have proved that Tubman was guilty?
Of course not.

University SRBs are not courts of law and have no such burden of proof. They are more in line with a civil court which has a far less stringent burden. The most extreme punishment they can wield is to dismiss the student from that school. As long as universities are liable for what happens on their campuses they are going to retain the right to control who is admitted and who is dismissed.
