The ruling today by SCOTUS was not a ruling on the merits of the case.

This 7-2 decision is an injunction that blocked the government from summarily deporting alleged Venezuelan gang members under the AEA.

The Court ruled that the government failed to provide sufficient notice to detainees, as mandated by the earlier April 7, 2025, decision.

They also found that the 5th U.S. Circuit Court of Appeals erred in denying relief to detainees. This ruling addresses the procedural issue of whether detainees were given adequate opportunity to challenge their deportations via habeas corpus, not the substantive legality of invoking the AEA or whether gang activity constitutes an “invasion” under the statute.

It’s going back to the appeals court.

I would like to give the Supreme Court credit by forcing the lower court to clarify their decision, they are making it harder for future lawsuits.

But they are also helping in another huge way.

When the Supreme Court FORCES the lower courts to clearly define their ruling and requirements, it helps to eliminate the ability of leftwing judges in the future to “interpret” the law based on their own political beliefs.

The Supreme Court is actually helping to clean up and transform the court system so that it’s harder for activist judges to interpret law in a way where they are watering down the constitution and creating new law.

Roe vs Wade is a perfect example.

Clarity actually strengthens the law.

The Alien Enemies Act is actually going to be strengthened because the Supreme Court is FORCING clarity on the lower courts ruling.

The lower court is the one under scrutiny here.

Not Trump.
