It's obvious he killed him. Question is was it homicide (the killing of one person by another) or murder (the unlawful killing of a person by another).

He gets charged, he's the only witness to what occurred. It will be up to a jury (or judge if he waives that right) to decide that.

Phillips has the right to remain silent, but since apparently there are no other witnesses IMO it practically forces him to testify.

He "killed" an admitted gang member and murderer and he's on record (via letters to the outside) saying that he feared gang retribution and intimidation and repeatedly asked for solitary.

Self-defense is pretty obvious, especially in a case without witnesses.
