Here's hoping that clearer heads will prevail, so a calm, rational, detached discussion regarding race relations within the context of policing can take place.

Here's the thing, he should of never been chargerd with murder. That's the problem. The charge should be negligent homicide it and of course obstruction for lying about what actually happened. Having a rebel flag as under shirt certainly does help his cause. Murder shows intent and in this case he didn't intend to kill the guy but he was reckless and of course negligent. They will retry him on those charges and he will be convicted I believe

Hamilton County Prosecutor Joe Deters said he thought the jurors did their best and pointed out that the trial involved a great amount of evidence and was a complicated case.

"I'd be lying to you if I didn't tell you I was disappointed," Deters said. "What we do know, is that they were leaning towards acquittal on the murder. They were leaning towards conviction on the voluntary manslaughter, but they just couldn't come to an agreement."


Deters said the Dubose family would like for him to re-try the case. Deters said he will make that decision by Nov 28.

"I'm going to go through a process where we analyze whether or not there's a probability of success at trial. If I think we can get a win, we'll retry the case," Deters said.

The sad part is that Cincinnati's policing has actually been a pretty good model of race relations and community based policing since the reforms brought on by the 2001 riots.

And a UC rent-a-cop blew it, because the Cincinnati cops weren't protecting their own beat around UC's campus. So the big business of UC had their cops patrolling off campus neighborhoods.

Not sure I agree with the last part, but this is correct to some extent. Policing improved city-wide in response to the 2001 riots because Cincinnati Police entered into a consent decree with the Department of Justice. But Tensing worked for UC Police, who weren't subject to the decree's requirements.

And Tensing led the department in number of stops, citations, and arrests in the year prior to the Dubose shooting. He also had the highest racial disparity among those he stopped of any UC officer. This was in part because UC Chief of Police Jason Goodrich implemented a policy encouraging more stops and arrests, but his numbers are striking.

These cases are tough. As someone else suggested, I'd like to see the prosecutor add an obstruction charge or something similar and go for it one more time. I suspect they left it out initially because they didn't want to give the jury an out on something that carries less time. But that's extremely frustrating when you consider how prosecutors typically over-charge defendants with everything under the sun to ensure that they at least get some kind of conviction.

UC cops should be patrolling UC's campus. That's it.

UC is landlocked by some of the most dangerous streets in the region - which Cincinnati cops have never cleaned up. I think the pressure of the money-making machine of UC and its partnerships with surrounding real estate developments around campus is what lead to UC rent-a-cops patrolling streets that had no business patrolling.

They want to clean things up enough that Sally from Mason could live off campus while her parents pay high rents to private companies for her to live resort-like quality of life she will never experience post-college.

And Sam Dubose and his two pounds of marijuana driving around aren't good for business. They are small potatoes.

Deters said he would decide on a retrial by the Monday after Thanksgiving. Not sure that's a smart move given the national publicity. I doubt he has much of a choice as well. It appears first degree murder is not going to work as he looks like a rookie in the media.
