Mitch gets so many emails from complaining fans. That is definitely not the most efficient way to reach him.

For some reason I don’t think that defense will hold up

If he got that email he's charged with notice. Noone in his position can disregard that as spam. He has an affirmative duty to act. If he thought it was spam, he should've called the sender like compliance training tells him.

That's not an email he can use an ostrich defense.

Simply sending someone an email with a somewhat vague assertion about a relationship with an unnamed student at another institution is not necessarily sufficient to rise to the level of notice based on Title IX case law.

Determining when an institution obtains actual knowledge is not that cut and dry.

Iirc the complaint said the email contained a warning he should not be allowed around female student athletes. If it really said that, that's plenty cut and dry.

It is really bad. I read the story and was shocked. This dude raped multiple women associated with UK swim team. Mitch and others athletic department staff were warned of the man's past and fielded complaints that went unanswered.

Yup he deserves everything coming his way if true and so does everyone involved especially because they know about him when he was hired.

I appreciate your thoughts on this. It's digusting, and as a UK grad I'm a little sick to my stomach this morning. One of the first questions I have is at the beginning. Did the guy from Toledo tell UK in 2012 that he had seen Jorgensen having sex with an incapicated girl swimmer on the Toledo university video? That isn't clear. But if he told UK he saw the video in 2012, our AD is done I believe. Did UK do any kind of investigation at all in 2012 after receiving the email? If so, who did UK talk to?

Yeah we have to do better. We aren't Kansas for God's sake.

Was the dude charged and/or convicted of rape when at other schools , or was it just a rumor or allegation? There’s a huge difference . If it was some sort of hearsay, I’m not sure you can act on that

The major issue is that in today’s climate everyone is presumed guilty which is very dangerous.
