As for your second gambit, yes and no. Governor's can activate NG in their state....no question. But this not binary argument. The CIC has command of ALL US Troops. (Active and non active). The SC has already ruled that he(CIC) can. But even that isn't the argument being made by Pritzker and company. They are claiming he can't conjure up an emergency to use that authority. The problem with that reasoning is for the NG to be activated for any issue, the President needs to "declare" an emergency. Which is the perogative of the COC. It does not necessitate the approval of a governor.
