I really dont see any institutional trademarks that were violated unless the university has trademarked "Aggies" "Whoop" or "Howdie"
Aggies is a trademark of Texas A&M. It's almost assuredly limited to reference to Texas A&M, and this would definitely infringe upon that.

Let me restate for clarity. Texas A&M has a trademark on "Aggie" as a reference to Texas A&M athletics.

New Mexico State and Utah State are not infringing on the trademark when they use the term Aggies, because they are not referencing Texas A&M. This billboard is.

Where do you get that? A search of trademark registrations finds no registration on "Aggies" as a single word and the registration on "Aggie" is this:

A trademark does not have to be registered to be protected. But it's entirely possible that Texas A&M's claim on Aggie would not stand up in court. Trademark law is not exactly black and white. Still, the combination of "Aggie" with the colors of maroon and white, not to mention the other Texas A&M references would probably provide Texas A&M with a pretty good case.

Considering they registered ALL the trademarks except "Aggie" and "Aggies" I have a feeling they would not win. Thereis a reason they haven't registered those, multiple schools use them including Mississippi State.

They would probably have been alright if they

hadn't used all of the following: Aggie program academics SEC

and instead used Aggie Nation We are the best in the South. Then you could argue Aggie Nation could mean a number of things. It will be hard to argue any product of institution other than Tex AM when you put together all of the other words on the billboard.

However, nothing will probably come from it anyway unless it goes viral.
