Depends on the details. Minimum security, probably with weekend releases etc., and no sex offender status, then hell yeah that's a good deal over facing 10 years in prison. But if it's 2 years in hard core prison....eh, not so much IMO. I figure if i can do 2 i can do 10, so might as well roll the dice. And i don't figure i can do 2.
Unfortunately, he didn't give the guy at Krystals the option of "doing 2".

Looks it sucks he got balls in his face, but its not sexual assualt. The guys didn't deserve to have his life ruined by being dumb. Did he deserve some punishment? Sure he did but not prison time.

Yeah, but if you get two, you'll really only do a few months. And that ain't so bad. Plus he's probably a good candidate for house arrest for the bulk of those few months. Plus he probably avoided felony charges on his record.

Again I ask, how can putting your balls on someone's face not be a sexual battery? Of course it's not like he raped someone or was abusing children. That's why he wasn't charged with rape or child abuse. But putting your balls on someone's face is pretty much the definition of sexual battery.
Think of it this way, if he's willing to do that to someone in public
it makes me feel uneasy about what he may do to an incapacitated person when other folks aren't looking. Remember, he did this to a stranger. Maybe the incapacitated person is someone's sister or mother next time? Maybe it's a mentally handicapped person next time? Instead of Krystal, she might be passed out on someone's couch or anywhere else he doesn't have to worry as much about those pesky prying eyes.
If you do something sexual to a person that can't defend against your aggression, you deserve a stiff punishment regardless if your intention was a joke or not. You have established yourself as having poor judgment and an endangerment to people that can't defend themselves. You need to be taught a lesson.

Are you suggesting that he didn't intend to put his balls on the guy's face? I will concede that if they somehow accidentally came out and accidentally brushed against the guy's face, then it probably wasn't sexual battery. I really don't think that's what happened though.

By intent I think he meant this clause that alot of states have "for purposes of sexual arousal, sexual gratification or sexual abuse...". Louisiana does not have that clause.

I think he means that it wasn't done with an intention towards sexual gratification. granted, he used his sex organs as a means to humiliate someone, but did he do it for his own sexual gratification? I don't know. I can't read his mind, but I doubt it. Not saying he was right or wrong or should receive a lighter/harsher sentence, but the question of intent would apply more to his motivations for doing it rather than the act itself. That's how I read it at least.
Using that logic, he could have butt raped the guy and it would have been fine since his intent was just to embarrass him and have some sick fun. I agree this isn't nearly as bad as what a rapist or child abuser has done and I think the plea bargain was a fair deal for both sides. But there's just no way in the world to deny there was a sexual nature to his crime. There were a lot of other ways he could have embarrassed the guy and had some sick fun that wouldn't have led to anything like the charges he was facing or pled guilty to.
i disagree. i think this guy just thought it was funny. we all know a couple of people who either teabag someone or received a ********** while passed out. it's one of those immature drunk college pranks that kids have been pulling on their passed out buddies for decades. i don't think these guys are closet serious molesters who are just waiting to rape a passed out girl or dip their balls on someone's sleeping grandmother or mentally/physically disabled cousin or whatever.
big fine, significant community service, and tort liability (should the victim pursue it) are more than enough deterrent to the average citizen. and if someone is sick enough to continue tea bagging after that kinda punishment, then they are a threat to society and nothing short of life in prison will protect inoocents from unsuspecting teabaggings.
I read where he will probably serve about 9 months. That seems fairly reasonable. Based on what I know of the case I would have suggested 3-6 months of actual jail time plus some fines and probation.

I am a lawyer, and I think the guy is a 17ing sick ******* who took his testicles out in a public restaurant--TOOK HIS TESTICLES OUT IN A PUBLIC RESTAURANT-- and rubbed them on a stranger's face. Jesus Christ. I hope this sick bastard need a new sphincter when he gets out. I see people go to jail over much less heinous offenses.
