If Kiffin leaving Ole Miss does not affect their payoff situation for Ole Miss could FSU bring a lawsuit against the NCAA for the millions of dollars they missed out on for being left out in 2023?

IIRC, FSU got left out due to injury to QB, and it was obvious they were not the same team w/o the QB in the ACC title game.

General rule of thumb: anyone can sue anyone else for any reason at all or no reason at all. The answer to your question is “yes.”

But what you intended to ask is whether there is a viable cause of action in favor of Flarda State for having been left out of the playoffs. And that answer is “no.”

Wasn't fsu left out of a 4 team playoff?

I get the comparison but the situations are different. OM would be out of a 4 team playoff without Kiffin.
