And re-build skybozes, the press box, and a club level.

I really like Ole Miss' club level the built, but I would still want to have private suites like we do now.

6pack needs to start taking some of our money from the chest, stop buying DS televisions and instead start loading up on powerball lotto tickets. A fool proof plan.

AD employee. Indicated the same thing. DNF is 4th on the list. BBall practice/DWS west side upgrade/ Track upgrade then DNF. Just the way it be.

is that we have an AD that realizes that there is a problem, and that he will fix it. LT tried to destroy our baseball program- intentional or not. While I have no proof other than my gut feeling, I really at least halfway believe that he had the deck in RF rigged to collapse so that he could say that the LFL was hazardous and shut it down.

LT sold the masses on "We still have the best baseball field in the country" and they bought it and Polk did nothing to try to fix any of it either. Polk had the power to get at least some of that stuff fixed, or at the very least bring it to people's attention.

I should send Greg Byrne a Christmas card for dethroneing Polk and his band of merry men and banishing them to Jonesboro, Arkansas where no one gives a crap.

I can't wait until Cohen bans, cuts, executes, or graduates the rest of Polk's players so that we will have a team that will go out there and win. I miss seeing good players at MSU.

but I wouldn't put it past him. I had heard that LT wasn't very fond of the LFL because it was "a fire hazard".

in that LT wasn't fond of LFL. However, his main concerns were aesthetics and liability. He never appreciated the atmosphere, which is a shame. Also, everytime he looked out there, he probably envisioned one of the rigs crashing down and killing somebody - and then the athletic dept writing a huge check. Thus, he was probably sick when RF collasped - as he knew somebody would be getting money out of "his" dept.

there was an easy solution to that problem - make all the owners of the rigs sign a liability waiver releasing the AD from any responsibility. That, and put a sign at the entrance of the LFL stating that the AD wasn't responsible for any injuries from the rigs out there. lawdawg02, feel free to correct me. As far as aesthetics, yeah some of the **** is ugly out there, but it's a unique tradition that LT could have capitalized on, financially and from a publicity standpoint, rather that focusing on getting rid of it.

sure, as the owner of the premises you would have a signed waiver in hand. however, such a broad waiver as that (or as would be required in your scenario) would probably not hold up in court. think about it like this - say you have everyone who enters the upper deck at scott field sign a waiver that relieves msu from liability if the upper deck comes crashing down. well, there are certain things that simply can't be reasonably waived, especially structural integrity when dealing with invitees (or licensees as ticket holders).

now, with the LFL, i think the school's best bet (in case of injury) is a defense of assumption of the risk, meaning that you should have known better than to scale your way up the plywood skyscraper hauled in by the old drunk guys, that is in no way affixed to the stadium. there is still an issue as to premises liability, though, because it's still on school property, so the school probably should be taking reasonable measures to ensure the stability of the structures, even though the school does not own or maintain them. i don't know if they do that now or not. </p>

collaspes and falls on a child, resulting in serious injury or death. With the current setup of LFL, I don't think there is any legal remedy that would save MSU from having to pay. Is there?

my lawyer drew it up and it is pretty clear. HOWEVER, if reasonable effort is not shown in providing a safe environment, I can still be sued and lose. Foe axample: A General Manager of a hotel in Deleware went to jail for failing to fix a safety problem once he was made aware of it. He was told several times (came out in court) That the cement deck at the pool had seperated and someone was going to trip and fall. He did nothing. I kid tripped, fell and drowned. He went to jail for involuntary man and the family was awarded 5 mil.. As long as youy show reasonable effort to correct identified problems, you are safe. In other words, do you damn job.

Well, there are certainly things you could argue, including assumption of the risk, joint contribution among tortfeasors (i.e., the owners of the structures), etc., but, no, I do not think MSU could escape all liability in such a situation.

Edited to add: This would be similar to the principle with the frat houses. The university dosen't own the house it just leases the land.

if memory serves me correctly. that guy in delaware is a MORON.

as far as the kid scenario that someone else mentioned, i don't see how the school could completely escape any liability, unless the safety of the rig was not in doubt and it would not have been reasonable to take steps to ensure that no one could get underneath the rig. if something like that happened, you could probably kiss the LFL goodbye, at least as it is and has been.</p>

The basketball PF is the highest priority.

Football is still football and DWS needs some help.

No idea about track. If it really is in complete dire straights, maybe it belongs here.

Then baseball. Heck, if Cohen gets some serious success going, maybe a gift or an alumni group would step forward and speed the process here.

If the unversity forces the LFL structures to pass some sort of building code, preferably inspections performed by city inspectors, it would probably show more than due diligence on the part of MSU. It would probably cause some of the loungers to upgrade to bigger better structures.</p>

One thing to note is that, I believe if football or basketball were to move up in success then it may push back baseball in order to further improve the respective facility.
Example, say that football goes to a bowl game this year and next, which would probably put average attendance above 50k, then everyone will be screaming for north endzone and want us to wait on DNF for another year.
