UK/JMI go after KSR

I have some experience defend a business trademark. The advice given to the company I was a part of was that you need to vigorously defend your trademark every time it is infringed upon. Intentionally overlooking any abuse can ultimately work against you in court, if it ever gets that far.

A previous poster was correct in saying that UK could simply grant MJ and his business a license to use UK's logo. BUT, I would bet JMI would have to sign off on it as part of their contract with UK. So, JMI has the final say in all of this.

However, there are ways around stuff like this. Look at how non-sponsors of the Super Bowl promote their business tie-in's by referring to it simply as "the Big Game". Kroger comes to mind in this regard. I'd say MJ could simply promote his business as a place to watch the next "Wildcats game" or "KY game" and be perfectly fine.

I'm curious the age of the posters here that think ksr is uks biggest cheerleader or source of popularity.

It's actually the exact opposite. If ksr ceased to exist, uk would truck along like always. If uk ceases to exist, that crew is finished. Matt could run for mayor of corbin, ryan do late night sports updates, Shannon do strip club promos, and drew back to two keys replica in his basement.

In reality someone is doing something wrong, knowing it's wrong, yet expects special treatment.

Exacrly right. I thought immediately of the Suoer Bowl Big Game silliness. But that is reality of defending the brand.

If you do not go after MJ then I will go ahead and use the UK logo. When I get sued I simply point to MJ and say, Judge...they let MJ use it and dont do anyrhing to him. I win. Simple as that. Laches.

Absolutely. His association with Marc Maggard launched him. Maggard was the one with the inside info from what I gather. That and what he gleaned from various sites, like this one. Not to take anything away from Jones, as he was smart enough to steal and present all of that info. He's really parlayed that into quite a business. He's on ESPN radio a lot. He's made a great career for himself. With a dubious start, nonetheless.

Yes. He got most his info from premium membership on this site when it was Kentucky sports report (was called ksr for short).

When they kicked him off the site, he started his own. Called it kentucky sports radio (ksr) to copy the Google search logic and try to steal traffic.

Iirc, he maybe even eventually threatened to sue them over the acronym.

No. You're partially correct; they later became rivals, I'm talking before that. Early on, they worked together. Maggard contributed to KSR, in its infancy. And even before that, on Matt's "Sports Mob" show. They had a split and each went his way. Maggard certainly lost the war, that's for sure. Jones is clever. He's out-maneuvered many people in his day. Gotta give him credit for that.

And with all that said, if anyone else doesn't remember or know what I'm talking about, just Google "ksr Marc Maggard ". You'll see the references to Maggard joining Jones on the Sports Mob talk show, let alone the ksr stuff.

Some clarification this should be noted. Your point is essentially correct but missing some points. If you fail to defend your IP you don't actually lose the rights. The next defendant can't use the argument that you let Matt Jones go so you have to let me go. What happens is that there are two parts to this equation. First is the judicial process and the second is the penalty or compensation. It's the second part that UK would lose.

For example let's say you get access to KFC's secret recipe and threaten to publish it. KFC can take legal action that will have teeth because that is something they can sue for probably billions of dollars. On the on the other hand let's take a second company that has published books detailing their recipe, how much can they sue for? Basically nothing. Why because you are exposing a secret that isn't a secret. The court may rule in the second company's favor but when the go to assess the value of the loss it would be basically zero.

The same is true of UK and it's IP rights. Every time they let enforcement go the value of those rights take major leaps toward zero value. If you own IP that is deemed by courts to be essentially worthless then you have effectively lost it. You can no longer send cease and desist letters when the other entity knows there won't be a penalty. You would no longer control your property.

This is what frustrates me with Matt. He is a lawyer. He knows this. He knew he didn't have a license to do what he did and yet he did it anyway. He then whines about it like he was mistreated. He was the one that was wrong here. He seems to be the type of lawyer that believes that knowing the law means there is always a way around the law. The ABA should be more aggressive in disbarring those types of lawyers.

Thank you for the reply. I am not a lawyer though I did sleep at Holiday In Express last night. My experience with defending IP comes from the creative side and having to learn about how/why from my lawyers. I know just enough to be dangerous and to have learned that defending your "brand" in this case is essential to having it maintain is value as you said. Jones is exactly as you described. He uses his training to find ways to skirt the law. Great explanation.

Maggard contributed relatively briefly. Had more of a guest blogger role and that was during Gillispie years. Back then, you visited KSR for the nightly post from Jones, which was the biggest draw of the site by far.

I hate bullies. UK and JMI biting a hand that helps promote them. Big money trying to stop the little guys.

Mitch lucked out with UK getting a part of the huge SEC tv contract because he sure can’t market. The no beer sales outside the Corp suites is another example of the regular guy bias. Ticket prices through the roof. It’s already tough going and here’s a local restaurant being threatened.

We have recruits committing in KSR and outside media and our coaches in their place several fundraisers. Watch parties. C’mon Mitch get out of the country club mindset and live and let live.

Just plain bullying.
I wouldn’t even know that UK athletics existed if Matt Jones didn’t “promote” it. He does this out of the kindness of his heart too, he should be above basic copyright and trademark laws.

This. I’m not sure why some here seem to think Matt Jones should be exempt from the same intellectual property laws that bind the rest of us.

Personally, I wish both JMI and Jones would just go away. UK was better off before either came along. And I truly couldn’t care less about their little pissing match with each other.

Yeah we have gotten 2 top recruits to the signing table and both fell apart I guess because Popes breath is bad? JMI is great and is causing no issues. Can’t wait to see all of our 5 star freshman play next year.

He wasn't "Mr. "rules are rules, you should follow them" back when he used to use my buddies photos on their site to get clicks. He worked his asp off to get that done. Then they even cropped his copyright marks off of the photos and were nasty towards him on the site and with people while doing it. Seems it's all fine and good to do it to others, but isn't cool when it happens to them.

He never got an apology for any of it. Didn't have the time or money to sue them to stop at the time either. All they had to do was ask him if they could use the photos, but didn't bother for years.

Guess that crap kinda comes around eventually.

It was one thing to keep them from using logos at their restaurant. It's another thing to keep them from using them on their site with regard to news. JMI wasn't going after ESPN or CBS over use of the logos on their websites. It does tell you something about that world of UK/JMI and all things money, because it is ALL about money

Our recruiting problems are squarely on the head coach.

But if someone needs to excuse that then JMI to the rescue.

There were some reports Pope was meddling in contract stuff too much at the end and messing it up. I don’t know what’s true, but JMI being the bogey man after all the Matt Jones drama in the past and Matt Jones now beating the war drum makes it seem pretty convenient and a little suspicious. I don’t think the average fan will ever know what the truth is. Maybe somewhere in the middle.

It’s the same one. I’ve thought for a while it’s some administration / JMI mole, either that or it’s a rival fan who’s just found a way to play angry contrarian to the masses and enjoys a gaslight troll. I mean JMI is clearly hurting Kentucky it’s been pretty much verified by beats / radio / agents / everyone with some sense.

He just gets on here to troll or he’s a mole from 1 of 2 places and gets angry because he can’t convince everyone the shark in the ocean is actually a Pike.

Matt’s fight with JMI is fine by me. The prostitution of UK’s image has gone so far into crazy town that I don’t know if we’ll ever get back. This administration at UK is just flat out insane. It’s a good boy network who’s only interested in landlording and pimping the brand for cash no matter what happens to the historical relevance or the men who build it. Barnhart is a hatchet man who’s here to sell out and not advocate for athletics, they want the money.

I said in 2004, Barnhart would kill athletics here, at least basketball. And he’s finally getting that done. He wants no expectations of elite position, he wants everyone to sit back and be apathetic while he secretly hatchets for powers that care nothing about Kentucky sports. He wouldn’t have survived anywhere but here, that’s why he stayed 23+ years even though that’s unheard or for AD’s and he admits he didn’t plan it. He knew as long as he was a hatchet man that didn’t advocate for elite sports and sucked the money out they’d keep him put.

So Pope is recruiting them, getting the deal almost closed, then at the end he comes in and "meddles with contract stuff", I have a bridge to sell you. Do I think Pope is an elite recruiter? No. But I also know the JMI contract language isn't something top recruits are going to tolerate when there are a hundred other options without any restrictions.

I think it makes sense to assume there's a little bad blood between Jones and JMI to begin with but JMI isn't helping their case for a long-term relationship as we sit here with 0 guys coming in. Stokes should already be wrapped up. Some of that is on them, some of it on Pope. None of that is on Jones.

My favorite Jones insult over the years however (because it's so weird) is some taking it upon themselves to mock his relationship with his mom. I remember responding by asking so it's bad if you love your mother and have a great relationship with her? It's bad that you want to mention her on your show? Of course, no one responded when I broke down the thought process of basically saying "haha he loves his mom! What a wimp!" Yeah, there were grown men online doing that.
