Not if their recruits can't read the billboard and that's been their recent trend.

"[The sign] violated NCAA bylaw 13.4.3.1, which prohibits advertising or promotional material "designed to solicit the enrollment of a prospective student-athlete."

So when ESPN constantly has specials that center around Mike Krzyzewski, who then advertises & promotes material designed to solicit the enrollment of a prospective student-athlete to Duke, ESPN & Mike Krzyzewski are in fact violating NCAA bylaw 13.4.3.1.

Somebody needs to contact ESPN & tell them to knock off all the NCAA bylaw 13.4.3.1 violations.

(Don't bother contacting the NCAA; they don't give a ****).

We got all but 2 or 3 of our top in-state targets last year... Those billboards are well worth the tiny slap on the wrist we'll get

just as soon as they give Penn State the death penalty for the cover-up of the ***-raping of little boys in Penn State football facilities by an assistant coach.

I used to like Feldman, but he has become cheerleader for Freeze, Orgeron, and Leach over the past few years. It's like he is a fan of unethical recruiting. Why would he tweet about an insignificant story?

It's been very quiet in Coral Gables lately, too quiet. If ever a program deserved the Death Penalty...

get more and more desperate each season and use any tactic to try to slow down our current momentum. We will beat them this year and next year at home, 5 in a row, the egos of those little rebel bitches can't handle our current domination over them in all sports. Xena reb and herescort service will surely get involved soon. Too bad, it will not matter this time. They are more irrevelant than any other time in their history, with the exception of their yearly klan meetings at homecoming, they literally can't handle the way things are going for themright nowand it will only get worse. Shep is going to be one depressed little butt pirate, buthe is definiteltthe "face" of their university. Not looking good for the confederates these days.

the The Ohio State University- University of Ohio rivalry. One's a national power, while the other's a low-level Division 1 program. The sooner the university of ole miss accepts their fate, and drops to the Sun Belt (or the Gulf South Conference) the better it'll be for everyone.

I only ocassionally watch Fox News (or any news station) for the comedy factor, but when I've seen Shep recently he looks very thin and gaunt with a bad looking spray-on tan to boot.

"designed to solicit the enrollment of a prospective student-athlete." Solicitation - v. so·lic·it·ed, so·lic·it·ing, so·lic·its. v.tr. 1. To seek to obtain by persuasion,
entreaty, or formal application. One of State billboards read "Come play with the best", and that is a solicitation. The Pro Bowl billboard is simply astatement.Whether you agree with the statement or not is irrelevant. It's not illegal to advertise or promote your school, only to solicit. Big difference. I haven't seen any OM billboards directly soliciting attendance. Maybe I missed them.

I'm so glad we have another pompous Reb on here with all of his legal wisdom to clear this up.

Welcome to the board! I'm Spacecataz!

A successful one anyway. That was anunsolicited and non-professional assessment from my lower-level nonlegaloffice. It just seemed like common sense to me. It's bizarre the amount of people you come in contact with daily with who can't understand what the hell they just read.

Anyhow spacecataz, thanks for the warm welcome.

How in the hell is "The road to the Pro Bowl goes through Ole Miss", or whatever it says, NOTthat "To seek to obtain by persuasion" part of solicitation? Am I misinterpreting the definition of persuasion?

You're not misinterpreting the definiton of persuasion. I think it's the "seek to obtain" portion that's important. To me, the Pro Bowl boardattempts to advertise/promote positivies of theuniversitybut doesn't directly "seek to obtain" attendance. Yes, I know that's the ultimate intentions of advertising. Whereas, the State board specifically says "Come play with the best". That seems to be a direct solicitation. There appearsto be a line drawn between advertising/promoting your university and directly asking for someone to attend. I wouldn't think there were issues with the "This is Our State" billboards. If that's not the case and all of the billboards were violations, then my theory makes no sense.

Who knows. I'm just trying to hang in for another 45 minutes. </p>

is all that much of a solicitation if at all.

But that isnt the reason the billboards are important to be taken down.

They demonstrate an arrogance, currently, of our program which is fairly insulting to your fanbase, entertaining to ours and dismissive of every other school in the state.

The very idea that someone pulled a meaning out of it to apply an NCAA rule to get rid of it is sort of like defining a cowbell as an artificial noise maker while ignoring an intercom system to play a fight song, or a band instrument from doing the same. It's annoyance is the reason for the action against it, not it's potential for gaining an advantage.

I rather enjoy the fact that it just simply gets under the skin of who it's intended to. Namely the Yancy Porter clan. We'll come up with more. Hell, I hope they all push the envelope on breaking a rule.

Hell, I'm sure it ruffled plenty of feathers. Not mine though. I was just attempting to interpret the rule. I thought it was fairly clever. People who get worked up over a billboard or anything else for that matter should probably seek some opposite gender companionship.

In the real world, of course your billboards were meant to try to get players to sign with you, just like ours were to get players to sign with us. But you stopped just short of crossing the line into directly solicitation. We didn't.
