this is why people dislike lawyers and the legal system. common sense doesn't prevail often enough.

i am going to love it when people start seeing aluminum bats in stores with permanent warning labels on them. terrible.

Louisville Slugger is going to build the best bat to the specifications allowed. It is the responsibility of the league to make the guidlines. Oh wait, it would have been in bad taste to sue a vetrans group. I hate that the kid died, but it is always someone elses fault.

kidding - this is a sad situation, as it is every time it happens.

what i don't understand about the aluminum bat debate is why no one has proposed a helmet for pitchers. surely, someone could design a helmet that allows the vision a pitcher needs while protecting from direct blows to the head.

it would be like wearing a cup. you hopefully never need it, and it's uncomfortable as hell. but it's worth it for that one time you need it.</p>

actually, was it the dairy queen at ellis ave and raymond road? if so, i'd say you're probably wasting your time suing.

/the sad part is that if you could prove injury, you probably have a good case, as they probably don't have adequate warning (see mcdonalds coffee case).

you're exactly right about it not looking cool. it would probably require a "helmet mandate" from the governing body of each level of the sport.

that is crap. I think the ball was equally at fault. Maybe they should sue the plant in Costa Rica that made the ball, or the delivery man that delivered it. Or maybe the kid that threw the ball that was hit...oh wait nevermind.

A guy that pitched for ecccccc got hit in the face and it messed him up pretty bad. When he recovered and started pitching again, he wore a bull riding helmet. Only in Decatur would you see that

killed me with a line drive when I was pitching against him back in the day...I was fortunate it missed me by the few inches- plain and simple...but that is part of the game. Its the chance you take.

The problem is this- Sports are not for everyone. There is a level of risk and danger associated with them. And even moreso now with people becoming bigger, stronger, and faster.
Football players take a chance of breaking their neck, legs, arms, and other injuries every day they step on the field.
Basketball players are in constant movement and are subject to heart ailments
Baseball players face hard hit balls or pitches hitting them in the head.

People die every year and thats a shame. But there is risk associated with playing, and fewer people each year seem to understand this. The "everybody can participate" movement is hurting sports. Not everyone should be involved.

My ex-brother-in-law did a lot of the design and testing of the first big barrel bats for Louisville Slugger. He had a facility built by LS at his home in Texas and experimented with many combinations of bat and load. LS wasn't pleased with how the ball was coming off some of the top performing bats they were making and demanded that he come up with something new. He warned them that the ball was already coming off the bat at dangerous speeds (especially for young kids) at that time and in the end resigned because they pushed and pushed for greater ball speed off the bat. This was some 10+ years ago when all this happened. He lived in Columbus most of his life, moving to Texas after a divorce.

What does that have to do with anything? It could still be used as a preventative measure for pitchers.
