I know an NCAA rep said just yesterday that requesting a benefit is a violation, but she didn't cite any specific rule. I was under the impression a request alone was not a violation...otherwise the question remains why did MSU keep recruiting Cam Newton after the request was made?

Don Jackson (yes, I know he's a douchebag, but he has more experience in NCAA compliance than anyone else posting on this board) says he has NEVER heard of a request alone costing a player his eligiblity. It is evidence that benefits were given out, but it typically is not a violation on its own.

I heard another NCAA expert -- I think it was on Fox, but I cannot find a link -- who said that the NCAA considers the circumstances surrounding the request, and one factor is the amount of the benefit requested. I think $180,000 is probably off the charts, but then you have the mitigating factor of Cecil doing this allegedly without Cam's knowledge.

In short, I think there is some question whether Cam is automatically ineligible, and if Auburn was clearly without knowledge then I don't think they will forfeit any games.

Do you think Rogers (or even Newton, Sr.) is an "agent" that nullifies Newton's amateur certification? I think the "for compensation" issue could be key.

12.3.1 General Rule. An individual shall be ineligible for participation in an intercollegiate sport if he or she
ever has agreed (orally or in writing) to be represented by an agent for the purpose of marketing his or her athletics
ability or reputation in that sport. Further, an agency contract not specifically limited in writing to a sport or
particular sports shall be deemed applicable to all sports, and the individual shall be ineligible to participate in
any sport.

12.3.3 Athletics Scholarship Agent. Any individual, agency or organization that represents a prospective
student-athlete for compensation in placing the prospective student-athlete in a collegiate institution as a recipient
of institutional financial aid shall be considered an agent or organization marketing the individual’s athletics
ability or reputation.

12.3.3.1 Talent Evaluation Services and Agents. A prospective student-athlete may allow a scouting service
or agent to distribute personal information (e.g., high school academic and athletics records, physical statistics)
to member institutions without jeopardizing his or her eligibility, provided the fee paid to such an agent
is not based on placing the prospective student-athlete in a collegiate institution as a recipient of institutional
financial aid.

and will notbe shocked if they play Cam tomorrow. While the solicitation may be against NCAA rules we dont know what the effect is.I suspect that a solicitation without payment may not result in automatic ineligibility.

There was no reason for Cecil to make the statement tonight except to get out that no benefits were paid, Cam did not know about the "discussions" and Auburn didnt know about it. Most likely was done so Auburn can continue to play him based on the argument that there is no precedent for the NCAA ruling a single solicitation or "discussion" of extra benefits results in ineligibility especially when the school he is at was not involved. If I recall, Cecil said there were discussions about money but didnt say he solicited money - Im sure the statement was very carefully crafted by Auburn lawyers who want Cam to continue to play and Auburn not to have to forfeit games etc.

At this point they may think theyshould continue playing him and if later ruled ineligible appeal on the basis of no previous precedent, not directly involved, no knowledge etc.

I actually heard another NCAA representative comment very briefly on this. The definition of "agent" is very loose, and the NCAA does not require that the agent be paid. So, if the NCAA were willing to look at Rogers' actions as "marketing the athletic ability" of Cam Newton, then there could be a violation. I have no idea if the NCAA would stretch things that far, though

Cameron Newton is not bigger than Auburn University. At this point I don't really care if Cameron is found inelgibleor not. Auburn actually made this thing worse in the media because of their reactions or lack thereof. If they had come out in the very beginning and said, "Look, we don't know what all is going on but we are cooperating with the NCAA investigation. Right now we are being told that Cam Newton is eligible to play and we don't want to punish him for issues that may or may not affect his eligibility." I think the entire world would have simmered down just a bit. But all those bastards attacking us for following the rules just made the leaks compound.
