His attorney says that the complainant is going to drop charges and can not believe he was arrested.

Ohh, he's done at Texas. This will take 2 - 3 years to rehab that image.

I am just saying how the legal system works. By all accounts he has no priors, and no evidence of violence in his past. He was, until this point, a respected member of the community. He has money and good lawyers. Trials cost a lot of money for the state and have low success rates. Not to mention the victim seems to be siding with Beard and would likely not testify against him. It will definitely be pleaded down as it would be for anyone in similar situations.
I just keep hoping against hope that one day our effing system will be fixed. Yeah. Naive I know.

Because if this was you or I we wouldn’t be seeing the light of day for ten years. And probably rightfully so. Everyone says the courts only see minority colors. Nah. Sadly it sees only one color. GREEN.

His attorney can bite me. I know we have to have lawyers but damn if some of them aren’t slime. The kicker will be if they get dropped and Beard she’s the police.

I love this country but damn does it piss me off some days. Today is one of those days.

If this gets pled down and he’s back on the sidelines, then Texas becomes the new LSU. Bankrupt of morals. Eff them. I still don’t see this getting pled without backlash in this day and ESPECIALLY in Austin. If it does get pled down, he’s still done. No way anyone is going to let their kid come near him. And if they do they’re idiots. Again, abusers are usually not one and dones. He will do it again. Bet on it.
If they don’t have a cooperating victim, then it won’t just get pled down but likely dismissed. No chance of conviction at trial without her testimony.

That’s a perk of having one of those mega million dollar contracts. Once a victim realizes it’s in her own best interests for a case to go away …well, it goes away. It’s good to be rich in this country.

I hope that mfer never even gets a job at Baskin Robbins. His *** deserves to be in jail.

On your post to me earlier that I can’t find, very sorry to hear you’ve experienced abuse in your family. I know the feeling.

However there are passive abusers and it works in a lot of different ways. A D1 football coach that screams and is short wired doesn’t equate to abuse in the home. That’s all I was saying.

This is really bad on the surface. Felonious assault isn’t a charge that’s given out on a whim.

I’ll hold my judgement until the facts come to light, but if proven to be true, I have no use for domestic abusers.
Depends on Texas law, in some states it’s automatic arrest for spousal fighting/domestic abuse type stuff. I’d say wait until all facts are out before we condemn him a woman beater.

This. As much as conspiracy crap gets talked about, felony charges don’t get tossed about like candy. At least not without substantial probable cause.
I can tell you that F6 in Indiana get thrown around quite easily. For some relatively minor stuff, especially if it involves theft.

So pure speculation…

They get into some fight, he chokes her. She calls the police and states as such.

Stockholm syndrome or realization of loss of lifestyle set in. She refuses to cooperate. This is why it occurred in September but just got arrested now.

Why was he arrested now? Perhaps a third party or friend got ahold of certain photos or texts and turned them over to police. Police now have enough evidence beyond a non cooperating victim. Arrest occurs.

This is ugly folks. Never ever choke anyone.
Yeah and then the report says 911 was called at 12am but he wasn’t arrested until 4:13am. Just a weird timeline too.

I'm just going to say the quiet part out loud. Chris Beard is a wealthy white man in TX, with some pretty good pull as the basketball coach at UT. Considering TX is about as conservative a place as you will find left in this nation, it appears he is getting no leeway as he was swiftly arrested, booked and they took their sweet *** time arraigning him. They clearly are very comfortable with the evidence and charges they have against him.
Considering Austin is now a hellhole of liberal stupidity, everything you just said has no weight.

Yes. It does. Has to officially. For a felony anyways.

Fifth Amendment to the United Staes Constituion:

“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury”

Felonies are Capital offenses.

You cannot be tried before a judge and jury until the DA present his case before a grand jury. When the grand jury says “Yes you have enough evidence and cause” to proceed. They levy an official indictment (meaning your *** is officially in deep ****) and the case proceeds to trial.

Now how strong an indictment is always up to debate (hence the old phrase a DA can indict a ham sandwich) but you cannot be officially indicted and formally charged with a felony until the grand jury says so.

The rest before is probable cause and investigation.
Felonies can be capital offenses but not all felonies are capital crimes.
