Hopefully they fix this NIL loophole so that kids like Cliff can earn NIL like everyone else. Otherwise, the best foreign players will start team hopping to a new team that is due for their once every 4 year abroad trip.

It’s not an NIL issue.
It’s intentional so foreign students don’t take jobs in US. There are hundreds of thousands of foreign students in US going to school on student visas

They need to make it so international student athletes can apply for athlete visas instead of student visas. Idk how realistic that is though

Is there an athlete visa?
Could Rutgers sponsor them on a work visa instead?

I have no idea what the laws are.

NIL isn’t a “job” in that sense. The kid earning the money isn’t taking employment away from someone else.

They are being hired by a private corporation in exchange for services (for example - social media post promoting a product).

If someone on a student visa is being hired, that is money not going to someone without a student visa.

I would imagine same restrictions are on student visa holders trying to monetize their social media platforms.

Perhaps the law needs an update considering how college aged people earn money nowadays.

Just marry a USA chick and get a green card. Split the NIL profits with the girl. Problem solved. :)

When auditions are held for roles in movies or TV shows filmed in the US, citizenship status is not a factor. A VISA can be obtained for a job function that is specific to an individual talent. NIL is exactly the same thing with respect to earning based on individual characteristics. There’s a clear argument that one’s likeness cannot simply be matched by a US citizen (that is, if that justification applies to a foreign actor vs. someone in the US who could be cast for the same role it should also apply to NIL).

If Mag can't earn NIL unless he is outside the USA how was a offered a big NIL package to transfer to Georgia Tech ? Georgia Tech does not have a foreign trip this summer, at least I could not locate one for them.

A possibility is they would have done something like this:
Adama Sanogo made a quick trip out of the country - made a commercial, took some promo pics etc and got paid for what he did OUTSIDE of the country - not subject to US Student Visa restrictions.
