O'Reilly is exactly right. Congress makes laws. Judges interpret those laws based upon the constitution and based upon congressional intent. It is not the job of a judge to make new law. The Constitution provides mechanisms for changes to the constitution that do make it a living document. However Democrats don't want to go through that process, they simply want to put judges in place that will arbitrarily make changes to the law based upon political whim.

Why do we need congress if it is the judiciary that is making new law based upon an evolving society and evolving feelings of that particular judge.

This is the kind of stuff that bugs me.
Once, during testimony about guns, Feinstein said she stuck her finger in a bullet hole of some of her friends in San francisco city hall who were killed by a gunman. The absolute stupidity of this was never followed up on by anybody. How about, Senator, you contaminated a crime scene with your finger? Democrats will lie no matter what, just to make political points.

I don't think that mattered much when it came to charging Dan White.

It's the hypocrisy of the left, saying she put her fingers into a weeping hole, nobody called her on it. Just like the democrat rep who was in the round table discussion with Obama. She said times were so tough back home, that one of her constituents was using her dead sisters dentures. Now, I'm a dentist, they are not a pair of shoes. They are custom made, no two are alike, but that doesn't stop the left from lying.

CITY HALL SLAYINGS / 25 Years Later
Dianne Feinstein was president of the Board of Supervisors. Her office was on the other side of City Hall. She heard a door slam in Milk's office, heard shots, saw the killer run out, went in herself and found Harvey Milk's body. "I put my finger to see if there was any pulse, and it went in a bullet hole in his chest," she said the other day. "I think of it as if it were yesterday. I remember Harvey's body, his blood on me. I see it all."

She may not be lying, but she is a moron. Who checks for a pulse at the point of gunshot entry? I guess maybe she was trying to feel if his heart was beating? I'll give her the benefit of the doubt but Jesus, wrists and neck.

Had a partner to stick his finger into a bullet hole one night. Back up to prior weekend. Call of a stabbing. Answered the call in a small joint, and a black male had a slit throat. He said he was OK that he could handle/take care of it. I Made report and moved on. Following weekend, got call of a shooting at the same location. Upon answering call, observed black male slumped over in a booth and another black male with white bandage around his neck who we recognized as the victim of prior week cutting. He told us he took care of business and shot the man who cut him the prior weekend. Partner examined the slumped over man and stuck his finger into a .45 hole in the dead man's chest. Made arrest and filed report.

So, he contaminated a crime scene? Brilliant and probably a lie. If not, he should have lost his job for being an idiot.

A politician embellishing a moment in time because her constituents want gun control. I'll stick with what I said, she's either lying or she contaminated a crime scene and should have been called on it. There's only one reason to stick your finger into a wound and that's to stop bleeding. How would you know it's not a bullet that explodes? Really, really stupid thing to do.

Maybe one hand was on his wrist while her other hand was on his chest. Why are you being such an idiot about this? It happened 39 years ago, what do you hope to accomplish? When you're first on the scene of someone who's been injured, are you really thinking about preserving a crime scene? She was interested to see if he was still alive. Don't you have other people or things to hate on? or better things to do with your time? smh

I hate politicians who lie about what happens to take advantage of a moment because some can't see thru the moment. She wanted the second admendment ended or restricted and lied about what happened to make a point that the idiots in the press would not ask her about. I don't believe for one second that Princess Diane Feinstien would do that. She could have made her point without using hyperbole. Just like the Dem Rep from Lousiana did about the fake statement about using her dead sister's dentures. Out and out lies.

Lighten up on the conspiracy theories Francis. I'd be surprised if more than a few San Franciscans had ever heard of her in 1978. You are a crazy person, get help soon.

First of all, she is an idiot. Let's all be clear on that point,

So "creating law" from the bench is a democrat thing? Without going back and doing some research here, I think the bench has grown too powerful in general. Nonetheless, there are some "laws" created from the bench that were positives in our nation's history. I know that Brown vs Board of Education sucked the life out of a faction of the right that voted for Trump. We clearly see why many on the right are still reeling from that case........ How about District of Columbia v. Heller? This was a case in which the Supreme Court held in a 5-4 decision that the Second Amendment applies to federal enclaves and protects an individual's right to possess a firearm. That seems to be a decision that went the way or the conservatives and for gun owners like myself.
